Agenda 09/11/2012 Item #16A 99`1,12: "w !te~- 1r.L..0 EXECUTIVE SUMMARY Recommendation to ratify and approve Change Order No. 5 to Contract # 08 -5130 in the amount of $46,034 with CME Associates, Inc., for Design & Related Services for Development of Accelerated Bridge Construction Standards and Pilot Bridge Construction; Project # 66066. OBJECTIVE: For the Board to ratify and approve Change Order No. 5, which was necessary to provide revised construction bid documents for the White Boulevard Bridge Replacement and to complete post design services. CONSIDERATIONS: Construction Bids were received on December 15, 2011, for the replacement of the White Boulevard Bridge and the construction of one new Bridge at 23rd St. SW including roadway improvements to 1 -mile of 23rd St. SW. Due to projected budget shortfalls the project was scaled back. The new bridge and roadway improvements at 23rd St. SVGS are no longer part of the construction services and the bid documents need to be revised and re- issued. On April 24, 2012, under agenda item 16 A. 13, the BCC approved the rejection of all bids under ITB 12 -5820 and authorized the re- advertisement for bids for the White Boulevard Bridge Replacement. The revised project will include the construction of a temporary detour over the Golden Gate Main Canal at 23rd St. SW while the White Boulevard Bridge is placed out of service. The reduced scorn° has saved approximately $3,950,000 from the project budget. The design changes in Change Order No. 5 is needed to effectuate that reduction. The South Floriaa Water Management District (SF WMD) has also stipulated that a condition of the permit modification for the temporary crossing will be a construction period from December 2012 to May 2013. This is the period when the Golden Gate Main Canal would have the least impact from storms. It was therefore imperative that the project be re- advertised for bids in July 2012 so that the construction contract reached the BCC for approval by the first meeting in September 2012. It requires approximately 3 months prior to the start of construction for the fabrication of the bridge elements (precast bents, precast pile caps, precast beams and prestressed piles). Any delays to this schedule would result in the contractor not being able to prefabricate the bridge elements in time. Staff executed and processed Change Order No. 5 on May 31, 2012, giving the designer four (4) weeks to provide revised construction documents for bids in July 2012. At the time staff processed Change Order No. 5, staff believed that the change order would be approved by the BCC at its July 24, 2012, meeting. Upon further inspection, however, staff discovered that Change Order No. 5 brought the accumulative percentage change to 11.36% since'the last BCC approved amount, which was $462,307.00 on November 8, 2011. Because the accumulative percentage increase on this project is in excess of ten percent of the current Board approved amount, staff is bringing the item to the Board to ratify and approve the issuance of Change Order No. 5. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office, is legally sufficient for Board action and only requires a majority vote for approval —SRT. GROWTH MANAGEMENT IMPACT: The project has been adopted in the CIE and is consistent with the Long Range Transportation Plan. The reason for the re- advertisement of the contract is that the County has decided to remove the construction of the 23 Id Street SW Bridge from the contract. Originally a new bridge was to be constructed on 23fd Street SW over the Golden Gate Canal. This structure would then be used as part of a detour for the replacement of the White Boulevard Bridge over the Golden Gate Canal. Since the 23`d Street Bridge is no longer being built, bid alternates will be added to the contract to allow for a temporary detour across the Golden Gate Canal where the 23rd Street Bridge would have been constructed. This temporary structure will allow White Boulevard to be closed to traffic and replaced in accordance with the current White Boulevard design documents. SCOPE OF SERVICES This scope of services is based on discussions with the County and is for additional design services for CME Associates and our Sub - Consultants to assist the County with developing bid documents for the re- advertisement of Contract 12 -5820. TASK- -4: UPDATING BID DOCUMENTS FEE: $12,562.00 WHITE BOULEVARD BRIDGE REPLACEMENT (LUMP SUM) This task will involve updating the Roadway and Bridge bid documents to incorporate the removal of the 23`d Street Bridge from the project as well as adding information regarding the temporary detour. This task will include, but not be limited to the following: • Perform engineering design and modify roadway construction plans to delete intersection improvements, adjust water management facilities and maintenance of traffic plan to utilize a detour bridge. • Updating construction cost estimate. • Updating special provisions. • Creating a new Construction Check List. TASK -2: TEMPORARY DETOUR (LUMP SUM) FEE: $14,918.00 This task involves preparing two bid alternates to provide a temporary crossing of the Golden Gate Canal at 2P Street SW. This crossing will be part of a temporary detour during the reconstruction of the White Boulevard Bridge. The temporary crossing will either be a temporary bridge or a temporary pipe culvert. The temporary bridge performance specification will be based on the specification created as part of CO No. 4 with minor modifications. The temporary crossing will only be in place during the dry season which is from December to April. This task will include, but not be limited to the following: • Modifications to the temporary bridge performance specifications as a result of the changes to the project. • The creation of a performance specification for a pipe culvert crossing of the Golden Gate Canal. This specification shall include Geometric Requirements, Culvert sizes (sized by others), material requirements, design loading criteria and canal restoration requirements. • Performance specifications shall include Canal and right -of -way restoration requirements after the crossing is removed. • Engineering design and Layout of the approach roadway and drainage facilities for temporary crossing of Golden Gate Canal. TASK 4: MEETINGS (LUMP SUM) FEE: $2,408.00 This task includes attendance of a meeting (by representatives of Q. Grady Minor & Associates) with the County and interested contractors to discuss the re- advertisement of the project. Additionally, this task includes attendance of a pre -bid meeting (by representatives of Q. Grady Minor & Associates). Change Order No. 1- The reasons for change order No. 1 are as follows: a) A modification of the design became necessary due to a change in the environmental resources permit criteria. The SFWMD requested that the allowable freeboard between the low member elevation of the bridge and the design high -water elevation of the canal be increased from 1 -ft to 2 -ft. b) Additional geotechnical investigation was needed to identify the extent of the rock layer c) Time was also added to extend the contract to allow for the above change in scope. 100 days were added to the contract. 2. Change Order No. - —The reasons for change order No. 2 are the following: a) An independent consultant was hired to provide constructability and design peer review. based on the resulting comments staff determined that additional time was needed for the designer to respond to the comments and make revisions to the plans. b) The permitting approval had also run into overtime which delayed the design completion. c) Time was also added to the contract to complete post design services task. 540 days were added to the contract. 3. Change Order No. 3 —The reasons for change order No. 3 are the following: a) Three public information meetings were held for this project, the first on April 22, 2010; the second on January 27, 2011 and the third on March 8, 2012. Due to public demand expressed at the first two meetings the scope of the project was expanded to include roadway improvements along 23rd St. SW and at the intersection of White Boulevard and 23rd St. SW. One mile of roadway improvements along 23rd St. SW (from the Golden Gate Main Canal to Golden Gate Boulevard) was added as well as a new signal at the intersection of Golden Gate Boulevard and 23rd Street SW. These additional services were provided by another consultant under the annual work order contract; however, the Packet Page -1751- 9/11120121 Item 16. L -C intersection improvements were added to the existing White Boulevard and 23r Street Bridge project. The reason being, the accumulative cost of the added improvements would have violated the CCNA rules if it were awarded to CME. b) The project completion was again delayed to allow time for the added improvements and the bridges to be constructed under one contract. Also there was a delay because the right of way acquisition had to be taken to condemnation. c) Although time was requested to provide post design services under Change Order No. 2, no funding was included until change order no. 3 because of the complexity of the different phases of the design. The final construction activities were identified under change order no. 3. 4. Change Order No. 4 —The reasons for change order No. 4 are the following: a) CME provided additional services to prepare a set of performance specification for a temporary modular bridge across the Golden Gate Canal at 23rd Street SW. On April 14, 2012 the BCC directed the County Manager to have staff investigate alternative temporary detour for replacement of the White Boulevard Bridge. Adding the new bridge at 23rd St. SW which would have been used as the detour for the White Boulevard replacement became unpopular in the eyes of the public and also impact fees that would have paid for the new bridge was diverted to over projects. 5. Change Order No. 5 —The reasons for changer order No. 5 are the following: a) The original project scope was changed. The new bridge at 23rd Street SW and roadway improvements to 23rd street and new signal were eliminated. This resulted in a change in the entire construction bid package.
