Agenda 05/22/2018 Item #17B05/22/2018 EXECUTIVE SUMMARY Recommendation to adopt an ordinance amending Ordinance No. 97-8, as amended, the Collier County False Alarm Ordinance, to clarify the requirements for the registration and re-registration of alarm systems and the responsibility for late fees. (Sheriff’s Request) OBJECTIVE: To support the enforcement of the Collier County False Alarm Ordinance by the Collier County Sheriff’s Office (CCSO). CONSIDERATIONS: The Collier County False Alarm Ordinance (Ordinance No. 97-8) was adopted by the Board of County Commissioners on January 28, 1997. Ordinance No. 97-8 was amended in 2014 to shift the responsibility of registration and re-registration to the alarm companies installing and monitoring the alarm systems. In 2016, the Florida Legislature passed HB 535, codified as Section 553.7931, Florida Statutes, providing that alarm system monitoring companies or contractors who install alarm systems are not liable for civil penalties and fines by any local government entity for the failure to register, which eliminated the County’s ability to enforce its Ordinance. As a result, the Board adopted Ordinance No. 2017-32 which shifted the responsibility for registration and fines back to the property owner. The CCSO has requested that Ordinance No. 97-8, as amended, be further amended to clarify that late fees are the responsibility of the property owner (referred to as the “responsible party”) for the failure to register or re-register an alarm system. This amendment also clarifies the expiration of the registration forms. At its May 8, 2018 meeting, the Board approved the advertisement of the attached proposed Ordinance incorporating the CCSO’s requests, and the Ordinance was duly advertised for consideration at today’s meeting. FISCAL IMPACT: The cost of advertising was $357.00. GROWTH MANAGEMENT CONSIDERATIONS: There are no Growth Management considerations associated with this item.
