Agenda 05/22/2018 Item #16A 605/22/2018 EXECUTIVE SUMMARY Recommendation to approve an Easement Use Agreement (Agreement) for Site 56, Block A, Pelican Bay Unit One, according to the plat thereof as recorded at Plat Book 12, Pages 47 -52 of the public records of Collier County. OBJECTIVE: To approve an Easement Use Agreement between the County and the current property owner of Site 56, Block A, Pelican Bay Unit One, 711 Bobwhite Lane, LLC. CONSIDERATIONS: The property is located at 711 Bobwhite Lane. There is a fence in the backyard located approximately 0.5 feet south of the northern property line which results in an encroachment into the 10-foot wide Pelican Bay Improvement District Drainage (P.B.I.D.) Easement on the North side, and the 6-foot wide Drainage Easement along the East side of the property, as shown on Exhibit A of the Agreement. According to the dedication language on the cover sheet of the Pelican Bay Unit One plat, all streets, roads and easements shown on the plat were dedicated to the “perpetual use of the public for the purposes shown,” and therefore the County has a property interest in the 6-foot wide drainage easement along the eastern property line. Moreover, the dedication language states that all Pelican Bay Improvement District Drainage Easements are dedicated to the P.B.I.D. Collier County is the successor to the Pelican Bay Improvement District by virtue of Resolution No. 90 -335, in which the County exercised its ability to succeed to the powers, rights, duties, functions and obligations of the P.B.I.D., and therefore the County has an interest in the 10-foot wide P.B.I.D. easement along the northern property line. According to the applicant, the purpose of this Agreement is to allow the privacy fence to remain. The County has never maintained the easement, and the easement is maintained by the property owner. There are no drainage facilities within the easement area. Development Review has reviewed the Agreement and Exhibits and recommends approval of the Easement Use Agreement. FISCAL IMPACT: There is no fiscal impact associated with this action. The property owners will be responsible for the recording fees. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. SAS RECOMMENDATIONS: 1. To approve the Easement Use Agreement between the County and the current property owner of Site 56, Block A of Pelican Bay Unit One, 711 Bobwhite Lane, LLC, and authorize the Chairman to execute the Agreement. 2.
