Visnich AMENDMENT TO AGREEMENT 16A3 THIS AMENDMENT TO AGREEMENT entered into this l'.}Iv day of ~ ' 2004 by and GEORGE VISNICH and VIRGINIA C. VISNICH, husb nd and wife, whose address IS 429 Ridge Court, Naples, FL 34108-2602, (hereinafter referred to as "Seller"), and COLLIER COUNTY, a political subdivision of the State of Florida, its successors and assigns, whose address is 3301 Tamiami Trail East, Naples, FL 34112, (hereinafter referred to as "Purchaser"). WITNESSETH WHEREAS, the Purchaser and Seller have previously entered into an Agreement for Sale and Purchase dated May 25,2004 for a certain parcel of land ("Property"); and WHEREAS, the Purchaser and the Seller are desirous of amending said Agreement to amend the legal description of the Property governed by the aforesaid Agreement to deduct 172 square feet recently purchased by the County Department of Transportation for road right-of-way purposes; and WHEREAS, the Purchaser and the Seller are desirous to reduce the purchase price of $477,500 by $1,300 to the new purchase price of $476,200 due to this reduction of 172 square feet in the size of the Property to be conveyed. NOW THEREFORE, in consideration of the mutual covenants and obligations provided within the said Agreement dated May 25, 2004 and other valuable consideration, the said Agreement is hereby amended to incorporate the correct legal description of the Property as shown in the attached Exhibit "A" and to incorporate the new purchase price of $476,200. Except as expressly amended herein the said Agreement between the Purchaser and Seller remains in full force and effect according to the terms and conditions contained therein.
