EXECUTIVE SUMMARY Recommendation to approve . a time extension for four months to Contract #07 -4131, "Gordon River Greenway Park" with Kimley -Horn & Associates, Inc. OBJECTIVE: That the Board of County Commissioners approve the time extension of Contract #07- 4131, "Gordon River Greenway Park" with Kimley -Horn & Associates, Inc. CONSIDERATION: Kimley -Horn & Associates, Inc. was provided a notice to proceed for completion of design and permitting of Gordon River Greenway Park on 03/06/08. Currently, Kimley -Horn is finalizing permitting associated with the design with the United States Army Corp of Engineers (USACE), South Florida Water Management District (SFWMD), and the Collier County Growth Management Division. Each permitting agency has received submittals from Kimley -Horn on behalf of the Parks and Recreation Department; however, final permits have not been issued. Currently, design of the Gordon River Greenway is. at 90% completion and should be 100% completed by July 2012; however, the current agreement expires on June 30, 2012. Recently, there has been additional community input into the design of a component outside of the Kimley -Horn project for the entrance road to the Naples Zoo. The design of the road entrance was completed by Q Grady Minor and Associates and an ad hoc committee associated with the Gordon River Greenway Stakeholders group has met and recommended consideration of (6) options including one option as to keep the entrance road as designed. There is considerable interest in preserving an unpermitted storm water pond that currently fronts the entrance of the Naples Zoo. If there is an option chosen outside of the original design, it will be necessary to allow adequate time for redesign work that will need to be coordinated with Kimley -Horn. Given this factor, it is necessary to request a time extension to October 31, 2012 to allow Kimley -Horn adequate time to complete the permitting and design related to this potential redesign. FISCAL IMPACT: There is no fiscal impact associated with this request. GROWTH MANAGEMENT IMPACT: Gordon River Greenway Park is inventoried as regional park land; however, this action has no impact to the growth management plan LEGAL CONSIDERATION: This item has been reviewed by the County Attorney's Office, requires majority vote, and is legally sufficient for Board action. — CMG RECOMMENDATION: Approve a time extension for four months to Contract #07 -4131, "Gordon River Greenway Park" with Kimley -Hom & Associates, Inc. Contract Extension Request Date: May 30, 2012 Contract 07 -4131: Design Services for Gordon River Greenway Park, Project A and Conservation Collier Preserve, Project B Current Contract Expiration Date: June 30, 2012 Requested Extension to: October 31, 2012 Justification: Reevaluation of Access Road: In April 2012, significant public concern was raised regarding the access road being designed by the Naples Zoo to provide the northern access to the Gordon River Greenway Park West Node. As a result of this concern, several alternative designs for the access road were developed, some of which would significantly impact the Park project and require a redesign of the West Node parking area. A decision to select the preferred alternative for the access road will not be made prior to June 26, 2012. Sufficient time will be needed to respond to the access road revisions and to provide re- design of the park node as needed based on the selected alternative. Conservation Easement Coordination and Permitting: Development of a Conservation Easement document is required. This document must be coordinated between and acceptable to the South Florida- Water Management District ( SFWMD), the US Army Corps of Engineers (COE), and- Cotner County. After initial submittal of a draft Conservation Easement to the SFWMD in February 2012, the SFWMD requested a waiver of their review and response time requirement in order to adequately address the conservation easement document. This requested was granted by the County. In May 2012, the SFWMD requested and was granted another two week extension for preparation of the Environmental Resource Permit, including the conservation easement documents. Permit issuance is expected by June 13. Final submittal and approval of the SDP application for the Park project is dependent on receiving the SFWMD and COE permits. Given the current schedule for issuance of these permits, the SDP process will extend past the current contract expiration date. As a result of these issues, a contract extension until October 31, 2012 is requested. Packet Page -1400-
