(Commissioner Hiller's request) Note: EXECUTIVE SUMMARY Recommendation to approve the conveyance of an Easement to Lee County Electric Cooperative for providing electric service to the Turbo Services Inc. leased site at the Immokalee Regional Airport located at 190 Airpark Boulevard, Immokalee at a cost not to exceed $27.00. OBJECTIVE: To obtain approval from the Board of County Commissioners in its capacity as the Collier County Airport Authority (hereinafter referred to as "Authority ") to approve the conveyance of an Easement to Lee County Electric Cooperative (hereinafter referred to as "LCEC ") for the installation of underground electric distribution lines for fiber optic telecommunications and television purposes at the Turbo Services Inc. leased site at the Immokalee Regional Airport. CONSIDERATIONS: On March 22, 2011, Agenda Item 13A2, the Authority approved the Long - Term Ground Lease and Sub -Lease Agreement with Turbo Services, Inc. to construct and operate a jet turbine testing facility. On March 27, 2012, Agenda Item 16G1, the Authority approved an Amendment to the Lease extending the construction start date. The Easement measures 12 feet in width and comprises a total of 2880.36 square feet, more or less, as shown and described on Exhibit "A" of the Easement. In order for LCEC to provide electric service to the Turbo Services, Inc. leased site, it will be necessary for the Authority to execute and record the attached Easement. FISCAL IMPACT: There is no fiscal impact to the Authority as a result of this easement. All costs relating to the construction of the jet turbine testing facility, including recording costs of the easement, will be paid by Turbo Services, Inc. GROWTH MANAGEMENT IMPACT: There is no impact to the Collier County Growth Management Plan. LEGAL CONSIDERATIONS: The Easement has been approved for form and legal sufficiency. This item is legally sufficient for Board action, and requires majority vote for approval. - JBW RECOMMENDATION: That the Board of County Commissioners in its capacity as the Collier County Airport Authority, approves the attached Easement and authorizes the Chairman to execute the Easement; and, also directs the County Manager or his designee to proceed to follow all appropriate closing procedures; and, to record the Easement in the Public Records of Collier County, Florida. By the execution hereof, Grantor covenants that it has the right to convey this easement and that the Grantee and its successors and assigns shall have quiet and peaceful possession, use, and enjoyment of this easement and the rights granted hereby.
