EXECUTIVE SUMMARY Recommendation to approve an extension for completion of subdivision improvements associated with the Audubon Country Club, Unit Three subdivision pursuant to Section 10.02.05 B.11 of the Collier County Land Development Code. OBJECTIVE: To approve an extension for the completion of subdivision improvements associated with the Audubon Country Club, Unit Three subdivision. CONSIDERATIONS: On September 12, 2000, the Board of County Commissioners approved the final plat of Audubon Country Club, Unit Three for recording. A copy of the original Executive Summary is attached. The Land Development Code requires that upon approval by the Board of County Commissioners a plat must be recorded within 18 months and the associated subdivision improvements must be completed within 36 months unless an extension is formally requested and granted by the Land Development Services Department. A previous extension was granted and expired on February 3, 2011. The Plat has been recorded, the improvements have received preliminary acceptance and there is a performance security in place. On April 1, 2002, the Land Development Services Department granted preliminary acceptance of the required subdivision improvements. Had the developer requested an extension prior to February 3, 2011, the approval would have been perfunctory. The developer has requested an extension of three years from the previous expiration date. An application for a three year extension from the previous expiration date has been submitted along with the appropriate fees. FISCAL IMPACT: The County will realize revenues as follows: Fund: Growth Management Fund 131 Agency: County Manager Cost Center: 138327 -- Land Development Services Revenue generated by this project: Total: $450.00 GROWTH MANAGEMENT IMPACT: There is no growth management impact. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed and approved this Executive Summary for legal sufficiency. This item requires a majority vote. REQUEST TO APPROVE FOR RECORDING THE FINAL PLAT OF "AUDUBON COUNTRY CLUB, UNIT THREE ", AND APPROVAL OF THE STANDARD FORM CONSTRUCTION AND MAINTENANCE AGREEMENT AND APPROVAL OF THE AMOUNT OF THE PERFORMANCE SECURITY OBJECTIVE: To approve for recording the final plat of "Audubon Country Club, Unit Three ", a subdivision of lands located in Section 8, Township 48 South, Range 25 East, Collier County, Florida, following the alternative procedure for approval of subdivision plats. CONSIDERATION: Engineering Review Section has completed the review of the construction drawings, specifications, and final plat of "Audubon Country Club, Unit Three ". These documents are in compliance with the County Land Development Code and Florida State Statute No. 177. All fees have been paid. Security in the amount of 100 of the total cost of the required improvements, and 1000 of the cost of any - remaining improvements, together with -a Construction and Maintenance Agreement for Subdivision Improvements, shall be provided and accepted by the Planning Services Director and the County Attorneys office prior to the recording of the final plat. This would be in conformance with the County Land Development Code - Division 3.2.9. Engineering Review Section recommends that the final plat of "Audubon Country Club, Unit Three" be approved for recording. FISCAL IMPACT: The fiscal impact to the County is as follows. The project cost is $153,373.00 (estimated) to be borne by the developer. The cost breakdown is as follows: a) Water & Sewer - $ 37,511.00 b) Drainage, Paving, Grading - $115,862.00 The Security amount, equal to 1100 of the project cost, is $168,710.30 Packet Page -1101- 6/12/2012 Item 16.A.8. The breakdown is as follows: a) Plat Review Fee ($425.00 + $4. /ac)- $ 477.00 b) Construction Drawing Review Fee Water & Sewer (.50o const. est.) - $ 187.56 Drainage, Paving, Grading (.42o const. est.)- $ 492.41 c) Construction Inspection Fee Water & Sewer (1.5o const. est.) - $ 562.67 Drainage, Paving, Grading (1.3 const est.) - $1477.24 GROWTH MANAGEMENT IMPACT: The Concurrency Waiver and Release relating to conditional approval has been reviewed and approved by the County Attorney's Office for the project.
