EXECUTIVE SUMMARY Recommendation to award Invitation to Bid (ITB) 12 -5850 Mitigation Credits to multiple vendors (estimated annual expenses: $1 million). OBJECTIVE: To issue an annual award to provide wetland and wildlife mitigation credits through issuance of a County purchase order. These mitigation credits may be purchased from these vendors by other County departments. Certain County capital projects cause unavoidable impacts to the environment. As part of the permitting process, both State and Federal Regulatory Agencies require these impacts to be mitigated. The County has historically used Mitigation Banks as one method of providing this service. CONSIDERATIONS: While Conservation Collier is in the process of establishing wetland and panther habitat mitigation banks, neither is in place at this time. Staff is currently working with the US Fish and Wildlife Service (USFWS) and the Clerk of Courts to resolve contractual issues relating to the Trust Agreement for the proposed panther habitat bank at the Caracara Prairie Preserve. Once the Clerk's Office and the County Attorney approve the final revisions to the Trust Agreement, the Caracara Prairie Preserve panther habitat units (PHUs) will be available upon final approval by the USFWS, which is expected to take several months. Pre - application meetings regarding the Pepper Ranch Preserve Mitigation Bank were held with both South Florida Water Management District (SFWMD) and the US Army Corps of Engineers earlier this year. The required permit applications were submitted to both agencies in April. Based on past experience, the County's project consultant estimates a minimum of a year, depending upon the amount and complexity of any requests for additional information made by either agency, before the Pepper Ranch Preserve Mitigation Bank is ready for use. Once wetland and/or panther habitat credits are available on County land, and providing that it is in the County's best interest to do so, these mitigation banks will become the County's primary source for mitigation credit. To ensure that there is no interruption or delay in projects, however, the County advertised ITB No. 12 -5850 on February 24, 2012. Notices were sent to 320 vendors and a total of 35 firms requested bid packages; of which six (6) returned bids on March 3, 2012. Line item bids were requested for wetland mitigation credits and panther habitat units. Staff implemented the Board's local vendor preference right to match policy on one line item ( #1 Herbaceous Freshwater) to LPI Wetland, which was accepted by the vendor. Mitigation will be purchased on a project by project basis; funding will be identified in each individual project budget. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office, is legally sufficient for Board action and only requires a majority vote for approval —SRT. GROWTH MANAGEMENT IMPACT: Mitigation credits will not impact growth management. RECOMMENDATION: That the Board of County Commissioners approve staff's recommendation to award ITB No. 12 -5850 to the identified firms on a primary/secondary basis to provide mitigation bank services pursuant to the issuance of a standard County purchase order.
