SECOND AMENDMENT TO THE ARTICLES OF INCORPORATION OF
CITY GATE COMMERCE PARK MASTER PROPERTY OWNERS' ASSOCIATION
The undersigned, being and constituting the Declarant as defined in the Articles of
Incorporation of City Gate Commerce Park Master Property Owners' Association, Inc. (the
"Articles") and being entitled to amend said Articles pursuant to Article XII thereof, hereby
amends the Articles by adopting this Second Amendment to the Articles of Incorporation of City
Gate Commerce Park Master Property Owners' Association, Inc. (the "Second Amendment") as
follows:
Article X of the Articles is amended to add a new Section 5, to read as follows:
Section 5. If, and to the extent that, any indemnification obligation of the Association
under this Article X shall result in the levying of an assessment by the Association on the
Members to cover the cost to the Association of such indemnification, then such
assessment shall not be levied upon, or valid against, any Owner where such Owner is
Collier County, a political subdivision of the State of Florida, or the State of Florida or any
special district thereof, including, but not limited to,the South Florida Water Management
District.
Additions are underlined and words stricken through have been deleted.
