QBJECTTVE: That the Board of County Commissioners (Board) accept an offer to release a $54,200 code enforcement lien, for payment of $19,281.15, in relation to Code Enforcement Board Case (CEB) Case No. CESD20090012965. CQNSI_iOERATIO„NS: As a result of code violations at 6090 Painted Leaf Lane, the Code Enforcement Board ordered the imposition of a lien ( "Lienj against the owner, Treasure B. & Jeff Ahlbrandt, in Code Enforcement Board Case No. CESD20090012965. The lien was recorded in the Official Public Records on May 6, 2010, at O.R. Book 4563, Page 1691, and the lien encumbers all real property owned by Treasure B. and Jeff Ahlbrandt. Based on accrued fines for the non - compliance period of 271 days at $200 per day, the accrued lien amount is $54,200 for enclosing a porch and adding a shed with no Collier County permits. On August 17, 2010, ,Wells Fargo Bank N.A. acquired the property through foreclosure. In the .foreclosure action (Case No. 2010 -CA- 0774), the bank attempted to foreclose on the Lien, but the court ordered that the Lien survives the foreclosure (see, O.R. Book 4596, Page 874). The property was brought into compliance on December 22, 2010. Pursuant to the amended Resolution, code enforcement liens and fines that accrued prior to new ownership and thirty days after date, of the recording of the Certificate of Title are considered for waiver as long as the new owner has diligently pursued abatement and compliance has been achieved. The fines; for the current property owner are in the amount of $19,281.15, representing $19;200 in fines and $81.15 in operational costs. Upon approval, fines consistent with amended Resolution section 4.1.D in the amount of $54,200 will be waived. FiIC� 1 PACT: The bank will provide payment of $19,281.15. If approved by the Board, accrued fines in the amount of $54,200 will be waived once payment is received.
