EXECUTIVE SUMMARY Recommendation to direct the County Attorney to draft a Resolution calling for a straw ballot referendum to be placed on the August 14, 2012 Primary Election concerning Collier County's Red Light Running Camera Enforcement System. OBJECTIVE: That the Board of County Commissioners (Board) considers placing a straw ballot referendum question on the August 14, 2012 Primary Election ballot relating to the County's Red Light Running Camera Enforcement System. CONSIDERATIONS: At its February 28, 2012 regular meeting (Agenda Item 11 -J), the Board approved a Settlement and Release Agreement with American Traffic Solutions, Inc., (ATS) for provision of Collier County's Traffic Infraction Detector Program (the Red Light Running Camera Enforcement Program). This Settlement and Release Agreement also stipulates that ATS will continue to provide services for implementation of the County's Traffic Infraction Detector Program for one year from the effective date of January 1, 2012 but thereafter the Agreement may be tenninated upon 30 days written notice to ATS. In order to address citizen comments and criticisms regarding the continued use of red light running cameras after January 1, 2013, 1 am asking the Board to consider placing this issue before the citizens by way of a straw ballot referendum question during the August 14, 2012 Primary Election. The straw ballot question will help the Board understand the citizen desires and provide guidance during future deliberations on this issue. The deadline for a straw ballot referendum to be placed on the August 14, 2012 Primary Election is June 8, 2012. If approved by the Board, the straw ballot language will be translated into Spanish and both English and Spanish versions will be provided to the Supervisor of Elections. FISCAL IMPACT: There is no immediate fiscal impact associated with this Executive Summary. If authorized, the cost of a straw ballot referendum would be limited to advertising and translation of the ballot language. GROWTH MANAGEMENT IMPACT: None. RECOMMENDATION: That the Board of County Commissioners directs the County Attorney to draft, for future consideration, a straw ballot question relating to the County's Red Light Running Camera Enforcement System and a resolution calling for the straw ballot referendum question to be placed on the August 14, 2012 Primary Election ballot.
