Recommendation to authorize the use of a contract issued under Invitation to Bid 10-
5569 for Bottled Drinking Water to Nestle Waters North America (approximate annual
expenditure, less than $50,000).
OBJECTIVE: To obtain Board authorization allowing County Departments to provide water
services to the public and employees under a contract issued under Invitation To Bid (ITB) 10-
5569.
CONSIDERATIONS: On August 6, 2010, Purchasing staff issued ITB 10 -5569 for Bottled
Drinking Water to obtain prices to purchase and deliver bottled water to various County offices.
Solicitation notices were sent to thirty five (35) email addresses; twenty four (24) vendors
requested solicitation information, and three (3) vendors submitted bid offers on August 26,
2010.
The Purchasing staff used an award formula to determine the lowest, qualified and responsive
bidder: Nestle Waters North America, Fort Myers, Florida. When the prices were evaluated and
compared with historic usage patterns, the Purchasing Department projected that annual
expenditures under the agreement would not exceed $50,000 and in accordance with the
Board's purchasing policy, the Purchasing Director awarded the contract on behalf of the
agency.
In the current fiscal year, actual expenditures under the contract continue to track below
$50,000 annually. However, the Purchasing Department has noted that encumbrances under
the contract presently exceed $50,000. Many of these encumbrances represent contingency
amounts for unexpected events and may not eventually be needed. However, to ensure
compliance with policy, staff requests that the Board authorize the purchase of water through
ITB 10 -5569 for Bottled Drinking Water to Nestle Waters North America to continue water
services to the public and employees. Based on prior years' history, it is anticipated that
expenditures will not ultimately exceed $50,000, but staff seeks Board authorization under the
contract should the annual expenditure exceed that threshold amount.
FISCAL IMPACT: Funds are appropriated in department budgets for the product and services.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this Executive Summary.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attorney's Office, is legally sufficient for Board action and only requires a majority vote for
approval —SRT.
RECOMMENDATION: That the Board authorize the purchase of bottled water through the
contract issued under Invitation to Bid 10 -5569 for Bottled Drinking Water to Nestle Waters
North America.
