EXECUTIVE SUMMARY Recommendation to approve an Interlocal Agreement between the City of Naples and Collier County for Contractor Licensing by Collier County for the City of Naples. OBJECTIVE: To obtain approval of an Interlocal Agreement between the City of Naples and Collier County for contractor licensing by Collier County for the City of Naples. CONSIDERATIONS: Collier County and the City of Naples have had similar agreements in place since 1992. The parties have found that the implementation of a City- County license has proved beneficial to both the City and County governments and its contractors. Having the County issue licenses and conduct investigations of violations of the Contractor Licensing Board Ordinance facilitates uniform application to both the City and the County. The Contractor Licensing Board has at least two members who reside within the corporate city limits and have been recommended by the City Council. FISCAL IMPACT: This is an enterprise - funded function that has no fiscal impact to the General Fund, and is a continuation of licensing regulation and investigation from previous years. Fees collected by Collier County for these services provided to the City of Naples are used to offset staff expenses incurred for providing support. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: Interlocal Agreements are authorized by Section 125.01(p), Florida Statutes. This item is legally sufficient for Board action and requires a majority vote of the Board for approval. - STW RECOMMENDATION: That the Board of County Commissioners approves the Interlocal Agreement between the City of Naples and Collier County for contractor licensing by Collier County for the City of Naples. SUMMARY: City Council is asked to consider a resolution authorizing the renewal of the City of Naples /Collier County Contractor Licensing Interlocal Agreement originally established on July 15th, 1992. The renewal period of the Interlocal Agreement is every five (5) years and is set to expire February 7 th 2012. BACKGROUND: On July 15th, 1992, City Council approved an Interlocal Agreement by Resolution 92 -6689 for the County to issue Contractor licenses in an effort to streamline the licensing process and avoid duplication of services, with the exception of lawn maintenance. On February 7, 2007, the City and Collier County approved Resolution 07 -11522 to renew the Interlocal Agreement for a period of five (5).years to expire on February 7, 2012. This system continues to work well for both the County and City. By streamlining the licensing and investigation process, we have eliminated unnecessary duplication of services for our contractors. Collier County continues to provide thorough investigation of unlicensed contractors and reprimands through the Collier County Licensing Board. The City has determined that the initial implementation of this service and its' continuation is advantageous to all parties involved and therefore it is our desire to renew the Interlocal Agreement for a period of five (5) years with Collier County. RECOMMENDED ACTION: Approve a Resolution to renew the Interlocal Agreement between the City of Naples and Collier County for the continuance of contractor licensing and enforcement by Collier County for the City of Naples. INTERLOCAL AGREEMENT BETWEEN THE CITY OF NAPLES AND COLLIER COUNTY FOR CONTRACTOR LICENSING BY COLLIER COUNTY This agreement by and between Collier County, a political subdivision of the State of Florida, hereinafter called the "County", and the City of Naples, a Municipal Corporation, hereinafter called the `City ", is made in order to set forth the responsibilities of Collier County for the issuance of contractor licensing, excluding lawn maintenance contractors. WITNESSETH: WHEREAS, the City and County have determined that the implementation of a City - County license has proved beneficial to both City and County governments and its contractors; and WHEREAS, the City and County desire to continue with an Interlocal Agreement, first adopted by the parties in 1992, with modifications to include tree trimming contractors. NOW, THEREFORE, in consideration of the covenants set forth herein, the parties agree as follows: 1. The County shall be responsible for issuing licenses to contractors working with the County and/or City in accordance with County Ordinance No. 90 -105, as amended. (latest amendment is Ordinance No. 2006 -46) (with exception of paragraph 1.3.1. Owner- Builders) and subsequent amendments and ordinances related thereto. 2. The County shall collect the licensing fees for those contractors licensed to work within the County and/or City for issuance of a countywide license. 3. The County shall provide the staff supervision, equipment and supplies necessary to issue all new and renewed contractors' licenses covered under this agreement and to provide all supervisory and investigative personnel necessary to investigate and prosecute unlicensed contractors before the applicable disciplinary boards, as well as investigate all related complaints. 4. The Collier County Contractor Licensing Supervisor shall supervise all Contractor Licensing investigations and advise the County's Building Division of same. 5. The County shall provide the City with monthly reports of the licensing and investigation activities within the City. The report is to include all activities related to licensing and enforcement within the City limits of Naples, including current specific complaints, investigations in progress, pending hearings and court Packet Page -1145- 2/14/2012 Item 16.A.3. cases and disposition of such cases. City staff will provide mutual assistance as required. 6. The County shall provide the City monthly reports of all contractors currently licensed in the County and City. 7. The combined County /City Contractor Licensing Board shall hear all disciplinary matters. The composition of the Contractor's Licensing Board shall include a minimum of two members who reside within the corporate city limits of Naples or shall be recommended to the Board of County Commissioners by the Naples City Council. 8. This Interlocal Agreement shall be in effect for a period of five (5) years beginning February 7, 2012. 9. Either party to this Agreement may terminate the Agreement by providing written notice to the other at least 120 days prior to the end of any fiscal year (September 3 0).
