Recommendation to Approve a modification to Disaster Recovery Initiative Grant Agreement
#IODB- D44&21 -01: R09 between the Florida Department-of Economic Opportunity (DEO),
formerly !mown as the Florida Department of Community Affairs (OCA) and Collier County to
change the grantor's name within the agreement, reallocate funds within the Immokalee. CRA's
Stormwater project and sign the associated subrecipient agreement amendments
OBJECTIVE., To modify Disaster Recovery Initiative grant agreement #IODB- D4-09- 21 -01 -KO9.
CONSIDERATIONS: On July 26, 2011, the Board approved Agenda Item No. 16D13, Disaster
Recovery Initiative grant agreement with the Florida Department of Community Affairs (DCA). Since
the execution- of that agreement DCA's name was changed to the Department of Economic Opportunity
(DEO). This item is -to modify the grant agreement in order to change the grantor's name within the
agreement, reallocate funds within the Immokalee CRA's Stormwater project, and amend the associated
subrecipient agreements to be effective upon DEO's execution of the modification.
The approved Grant Agreement designates $3,051,063.01 for the activity of flood and drainage for the
Immokalee CRA Stormwater project. The Immokalee CRA has requested that some of these funds be
reallocated for the activity of Construction Engineering Inspections.
The grant allows for a portion of the grant funds to be used for Engineering if calculated according to the
Florida Rural Utility Service (RUS) Bulletin 1780 -9. The amount of funds requested for engineering
inspections for this project was arrived at by using the calculation as required on The Florida RUS
Bulletin, Inspection Fee Table I. The amount of $2,718,000, the low bid received for the construction
portion of the project, was used to help determine the allowable funds for the engineering activity.
The resulting additional amount of allowable funds for Construction Engineering Inspections has been
determined to be $67,950. The changes to the line items for the Immokalee CRA Stormwater project are
reflected in the modification documents and the associated subrecipient amendments as noted in the chart
below.

FISCAL IMPACT: Approval of this item will not change the total awarded fimding amounts of the
grant or associated subrecipient agreements. Grant fimding has been previously recognized and remains
budgeted within Housing Grant Fund 705, Project 33104.
LEGAL CONSIDERATIONS: This item is legally sufficient and requires a majority vote for Board

GROWTH MANAGEMENT Il1VACT: Implementation of this Modification to Grant Agreement
and amendments to the associated Subrecipient agreements will further the goals, objectives and
policies of the County's Growth Management Plan.

MODIFICATION NUMBER 3 TO SUBGRANT AGREEMENT BETWEEN
THE DEPARTMENT OF ECONOMIC OPPORTUNITY AND
COLLIER COUNTY
This Modification is made and entered into by and between the State of Florida, Department of
Economic Opportunity, ( "the Department "), and Collier County, ( "the Recipient "), to modify DEO/DCA
Contract Number I ODB-D4-09-21 -01 -K09), award dated May 22, 2010 ( "the Agreement ").
WHEREAS, the Department and the Recipient entered into the Agreement, pursuant to which the
Department provided a subgrant of $9,963,208.00 to Recipient under the Small Cities Community
Development Block Grant ( "CDBG ") Program as set forth in the Agreement;
WHEREAS, the Department and the Recipient desire to modify the Agreement;
WHEREAS, pursuant to the provisions of Chapter 2011 -142, Laws of Florida, the DCA Division
of Housing and Community Development was transferred to the Department of Economic Opportunity
effective October 1, 2011; and the parties wish to reflect the new name.
NOW, THEREFORE, in consideration of the mutual promises of the parties contained herein,
the parties agree as follows:
❑ Reinstate Agreement
1. The Agreement is hereby reinstated as though it had not expired.
❑ Extend Agreement
2. Paragraph 3, Period of Agreement is hereby revised to reflect an ending date of (Type in date,
if applicable).
❑ Revise Activity Work Plan
The Attachment , Activity Work Plan section of the Agreement is hereby deleted and is
replaced by the revised Attachment , Activity Work Plan section, which is attached hereto
and incorporated herein by reference.
® Revise Program Budget and Scope of Work
4. The Attachment A, Program Budget section of the Agreement is hereby deleted and is replaced
by the revised Attachment A, the Program Budget, which is attached hereto and incorporated
herein by reference.

5. The Attachment A, Program Budget section, is hereby modified to delete all references to
"(Type in name, if applicable.)," as the Participating Party, and replace them with "(Type in
name, if applicable.)" as the Participating Party with the understanding that the Recipient and
the new Participating Party will enter into a Participating Party Agreement containing
provisions and caveats that meet or exceed the conditions agreed to in the Participating Party
Agreement between the Recipient and the original Participating Party.
❑ Inclusion of an Unmet Need as Addressed in the Original Application
6. The Attachment A, Program Budget section of the Agreement is hereby deleted and is
replaced by the revised Attachment A, the Program Budget, which is attached hereto and
incorporated herein by reference.
7. The Attachment , Activity Work Plan section of the Agreement is hereby deleted and is
replaced by the revised Attachment , Activity Work Plan section, which is attached hereto
and incorporated herein by reference.
❑ Change in Number of Accomplishments and /or Beneficiaries
8. The Attachment A, Program Budget section of the Agreement is hereby deleted and is
replaced by the revised Attachment A, the Program Budget, which is attached hereto and

® Reflect Change in Agency from DCA to DEO
9. This modification to the Subgrant Agreement hereby replaces "Department of Community
Affairs" with "Department of Economic Opportunity" where appropriate in context.

All provisions of the Agreement and any attachments thereto in conflict with this Modification
shall be and are hereby changed to conform to this Modification, effective as of the date of the execution
of this Modification by both parties.

2. Type in the Modification Number in the three fields where it asks for the number.
3. Type in the Contract Number in the three fields where it asks for the number.
4. Type in the Local Government Name in the five fields where it asks for the Recipient.
5. Type in the Date and Subgrant Amount in the fields on the first page where it asks for the
information.
6. Move the cursor to the appropriate box(es) to indicate the modification(s) being requested. Left
"click" on the box and an "X" will appear, indicating that the section is being modified.

line.

THE SUBRECIPIENT AGREES TO:
A. PROJECT SCOPE:
The Immokalee Area CRA project will purchase a minimum of five (5) acres of vacant land to
develop a storm water pond site. The land to be purchased may consist of a single site or
multiple sites. Additionally, the Immokalee Area CRA will undertake a flood and drainage
improvement project to result in the installation of a minimum of 13,625 linear feet of pipes,
swales, culverts, associated materials and related site restoration activities. The project will be
further defined in the construction agreement that will be subsequently approved by the Board
of County Commissioners. Project funds will also be used for Construction Engineering
Inspections as determined by the Florida Rural Utilities Service (RUS) bulletin.
