EXECUTIVE SUMMARY Recommendation to accept an alternate security in the amount of $1,758,578.20 from the current owner of the subdivision known as Copper Cove Preserve, and authorize the Clerk of Courts to release the previously posted securities. OBJECTIVE: To accept an alternate security to ensure the completion and maintenance of the required subdivision improvements within Copper Cove Preserve. CONSIDERATIONS: On March 14, 2006, the Board of County Commissioners approved the final plat of Copper Cove Preserve. A new developer now controls the subdivision entitlements and has provided an alternate security in the amount of $1,758,578.20 which is justified in the attached Engineer's Estimate of Probable Cost. The previous developer has two separate securities which have now been combined under a single Letter of Credit. Upon acceptance of the alternate security, the Clerk of Courts may release the Performance Bond with a current value of $1,736,024.20, and a Cash Bond in the amount of $22,554.00 posted with the Clerk's Finance Department and reflected on their 670 Refundable Deposits Account. FISCAL IMPACT: ^ There is no fiscal impact. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed and approved the replacement security for legal sufficiency. This item requires a majority vote and is ready for Board consideration and approval. STW RECOMMENDATION: To accept an alternate subdivision performance security in the form of a Letter of Credit in the amount of $1,758,578.20 from the current property owner and to authorize the Clerk of Courts to release those securities which had been provided by the original developer of the subdivision. The current securities are in the form of a Performance Bond (No. 58636677 and any amendments), and a Cash Bond in the amount of $22,554.00.
