Request to Speak under Public Petition Please print Name: Daniel McMahon Address: 2311 Woodland Estates Rd Naples FL 34117 -6807 Phone: 424 - 666 -7322 srmoose@hotmail.com Date of the Board Meeting you wish to speak: January, 24 2012 Must circle yes or no: Is this subject matter under litigation at this time? NO Is this subject matter an ongoing Code Enforcement case? NO Note: If either answer is "yes ", the Board will hear the item but will have no discussion regarding the item after it is presented. Please explain in detail the reason you are requesting to speak (attach additional page if necessary): The County is proposing to enter into a 3' Amendment to the Agreement between SFWMD and the County in which SFWMD will un -adopt portions of the Miller Canal, the C1 Connector Canal and the Golden Gate Main Canal's over banks and will give control over vehicle access to these areas to the county. I live along the Miller Canal on Woodland Estates Rd. SFWMD had strict rules (laws) as to who could access these areas with vehicles. At this time the County has no such ordinances or rules regarding vehicle access ^ to the over banks. I had built Woodland Estates Rd in 2002 and had worked with SFWMD regarding the building of the road. The eastern % of the road is on SFWMD's 95ft drainage easement, the western % of the road is on my (and other land owners along Woodland Estates Rd) ingress egress easement which is 30 ft wide. The reasoning that % of the road was on each easement was to give the residents and SFWMD access with 1 road instead of 2. I, and other residents along Woodland Estates Rd would like to keep the road private. If the County has no rules or laws regarding access my privacy will be lost. We do not want an ATV raceway that is outside of the County's control and outside of our ability to control who uses our private road, Woodland Estates Rd. At this time I pay for the roads maintenance and any additional traffic would cost me more money to maintain. Please explain in detail the action you are asking the Commission to take (attach additional page if necessary): I would like the Board to make an Ordinance restricting vehicle access (including ATVs) on Woodland Estates Rd to residents and guests only. If the County so desired it could extend this Ordinance to Frangipani and Woodland Grade roads. These 2 roads are also affected by the 3rd Amendment with SFWMD. Packet Page -20- 1/24/2012 Item 6.A.
