EXECUTIVE SUMMARY Recommendation to authorize the payment of impact fees, permit fees and associated charges in the amount of $16,041.16 from Fund 107, Impact Fee Administration, for Building Permit No.2006062448. OBJECTIVE: That the Board of County Commissioners (Board) authorizes the payment of impact fees, permit fees and associated charges in the amount of $16,041.16 from Fund 107, Impact Fee Administration, for Building Permit No. 2006062448. CONSIDERATIONS: In July of 2013, the prospective buyers of a distressed property in Golden Gate Estates met with the technical plan review staff of the Growth Management Division—Planning and Regulation to discuss the process to extend the expiration date of a 2006 permit in order to resolve outstanding Code Enforcement violations and complete construction of the partially built single-family home. The buyers were provided information related to various building-related matters; however they were not directed to the Impact Fee Administration Office. Typically, this would not present a problem, as the building permit for the home had been issued, and associated fees, including impact fees, would have been paid. However, the payment processed for issuance of the building permit in question was returned for insufficient funds (NSF). While the County subsequently followed the established process for NSF checks for this transaction, the fees were never paid and should have been collected prior to any new work commencing on the site. The new buyers were not advised that fees in the amount of$16,041.16 were due. Based in part on the information provided by the plan review section, the buyers proceeded with the purchase of the property. The structure required extensive work including entirely new trusses. The property owners are steadily working on the home to remove the blight and remedy all Code violations. On November 26, 2013, the owners were advised of the impact fees and other permit fees due, at which time they stated that they believed they had completed their due diligence with the County prior to purchase of the Property and were not advised of the unpaid fees. They also stated that they would not have purchased the property if they had been provided this information in advance. The technical plan review section assumed that fees were paid and were unaware of the NSF outstanding. The property owners disclosed that they have used their savings to buy and complete construction of the home; therefore they do not have the funds on hand to pay the additional fees and will not currently qualify for financing. The Project was originally permitted in the old CD+ system over seven years ago. The NSF was not an automated part of that system as it is in the new CityView permitting program. Staff cannot verify that the buyers were aware of the NSF outstanding. Based on the extenuating circumstances surrounding this issue, including the fact that the property owners contacted the County to research the subject Building Permit prior to closing on the property, staff recommends that the Board authorize the payment of the impact fees, permit fees and associated Packet Page-2117- 12/10/2013 16.F.5. charges in the amount of$16,041.16 from Fund 107, Impact Fee Administration. Fund 107 is the administrative fund for the impact fee program, which receives funding, in part, from administrative fees, interdepartmental transfers and application fees. In essence, staff is asking the Board to allow an internal fund payment to accurately account for the NSF. Approving this item will allow the Property to come into compliance and begin paying residential real estate taxes. FISCAL IMPACT: The amount of $16,041.16 is due for Building Permit No. 2006062448. Adequate funding is available within the budget of Fund 107, Impact Fee Administration, to facilitate payment to the various Impact Fee Trust Funds and Fund 113 and Fund 101 cost centers related to permitting. A breakdown of the individual fees is attached as back-up to this Executive Summary. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary.
