Agenda 12/10/2013 Item #16D 8 12/10/2013 16.D.8. EXECUTIVE SUMMARY Recommendation to approve two State Housing Initiative Program (SHIP) Satisfactions of Mortgage in the amounts of$77,000 and $5,500. OBJECTIVE: To obtain clear title to the property recently deeded to Collier County. CONSIDERATIONS: As background, on November 11, 2011, Housing, Human and Veteran Services Department was contacted by the Collier County Public Guardian office to inform us that a recipient of SHIP funds had been placed in a nursing home and permanently removed from her residence located on 402 3rd Street South, Immokalee, Florida 34142. The homeowner received funds in the amount of $5,500 under the SHIP Single Family Rehabilitation program for the demolition of her existing home. On July 26, 2006 a mortgage for $5,500 was recorded in Official Records Book 4078, at Page 2246 of the Public Records of Collier County. On July 24, 2007, One by One Leadership Foundation entered into an Agreement with Collier County Housing, Human and Veteran Services to construct a new affordable "green" home on the clients property located on 402 S. 3rd Street, Immokalee. The total amount expended on this project was $77,000 and on April 17, 2008 a mortgage in favor of the County was recorded in Official Records Book 4351, at Page 8 of the Public Records of Collier County. Item 16D17 was approved on the July 24, 2012 Agenda for satisfaction of two outstanding mortgages on the property. The mortgages were to be satisfied by the property being deeded by Guardianship Court approved Deeds in Lieu of Foreclosure back to the County. There was a typographical error on one of the Satisfactions previously approved by the Board and it referenced a mortgage which had already been satisfied in 2008. In addition, the Satisfactions were processed for signature and recording prior to the County's receipt of the deeds from the Guardian. In order to clear title, an Attorney's Affidavit to reinstate the one outstanding Mortgage was recorded in Official Records Book 4078 at Page 2246 of the Public Records. The County has received the recorded Special Warranty Deeds in Lieu of Foreclosure representing 100% interest in the property subject to these two mortgages. FISCAL IMPACT: Costs to record the Satisfactions of Mortgage in the amount of$20.00 shall be paid from SHIP trust fund account 791, Project 33222. LEGAL CONSIDERATIONS: The Guardian has waived the satisfaction recording deadlines set forth in Section 701.04(2), Florida Statutes, to accommodate agenda submittal deadlines. Accordingly, this item is approved as to form and legality and requires a majority vote for approval.—JAB GROWTH MANAGEMENT IMPACT: None. RECOMMENDATION: That the Board of County Commissioners approve two (2) satisfactions of mortgage in the amount of$77,000 and $5,500, respectively as attached; authorize the Chairwoman to execute the aforementioned Satisfactions; and direct the County Manager, or his designee, to record the aforementioned Satisfactions in the Public Records of Collier County,Florida.
