EXECUTIVE SUMMARY Recommendation to approve a release of lien in the accrued amount of$16,174.79 for payment of $1,874.79 in the Code Enforcement action entitled Board of County Commissioners vs. Chad C. Dixon, Code Enforcement Special Magistrate Case Number CEPM20120016145, relating to property located at 2313 Kings Lake Boulevard,Collier County,Florida. OBJECTIVE: That the Board of County Commissioners (Board) release a $16,174.79 code enforcement lien, for payment of$1,874.79, in relation to Code Enforcement Special Magistrate Case No. CEPM20120016145. CONSIDERATIONS: As a result of code violations at 2313 Kings Lake Blvd., the Code Enforcement Special Magistrate ordered the imposition of a lien against Chad C. Dixon, in Case Number CEPM20120016145. The lien was recorded in the Official Public Records on July 17, 2013, at O.R. Book 4944, Page 3740, and it encumbers all real property owned by Chad C. Dixon. The accrued lien amount is $16,174.79, based on fines for the non-compliance period of 59 days at $250 per day ($14,750), plus County costs ($1,424.79), pertaining to a pool with green water-algae. The property was brought into compliance on May 6, 2013. A Certificate of Title was recorded on August 16, 2013, conveying the property to the current owner, Federal National Mortgage Association. Pursuant to the Board's Resolution No. 2012-46, for Code Enforcement liens and fines on a property that has new ownership, fines that accrued prior to transfer of title and thirty days following transfer of title can be considered for waiver as long as the new owner has diligently pursued abatement and compliance has been achieved. In this case, the violation was abated prior to the new owner taking title. The property is in compliance, is being actively maintained, and an amount of $1,874.79 has been paid. This represents $112.29 in operational costs, $1,312.50 in county abatement costs,and $450 in fines. FISCAL IMPACT: Payment of$1,874.79 represents the County's costs and fines. If approved by the Board, accrued fines in the amount of$14,300 would be waived. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires majority vote to approve. This item conforms to the Board's policy contained in Resolution 2012-46. -KN RECOMMENDATION: That the Board waive the fines in the amount of $14,300, accept payment of$1,874.79, and authorize the Chairwoman to sign the attached release of lien. Nixon, Respondent The lien was recorded on July 17, 2013, in Official Records Book 4944, Page 3740, in the Official Records of Collier County, State of Florida. The lien secures the principal sum of Sixteen Thousand, One Hundred and Seventy Four Dollars and Seventy Nine Cents, plus accrued interest and penalties, if any, and imposes certain obligations against real property situated in Collier County, Florida. Collier County, a political subdivision of the State of Florida, by execution of this Release and Satisfaction of Lien, acknowledges payment as approved by the Board of County Commissioners as satisfaction of the lien and hereby cancels said lien.
