EXECUTIVE SUMMARY Recommendation to approve the release of lien in the accrued amount of$5,827.96 for payment of $1,527.96 in the Code Enforcement action entitled Board of County Commissioners vs. Crystal Pepper, Code Enforcement Special Magistrate Case Number CEPM20090011813, relating to property located at 3850 Recreational Lane, Collier County,Florida. OBJECTIVE: That the Board of County Commissioners (Board) release a $5,827.96 code enforcement lien, for payment of$1,527.96, in relation to Code Enforcement Board case number CEPM20090011813. CONSIDERATIONS: As a result of code violations at 3850 Recreational Lane, the Code Enforcement Special Magistrate ordered the imposition of a lien against Crystal Pepper, in Case Number CEPM20090011813. The lien was recorded in the Official Public Records on September 20, 2010, at O.R. Book 4606, Page 590, and it encumbers all real property owned by Crystal Pepper. The accrued lien amount is $5,827.90, based on fines for the non-compliance period of 19 days at $250 per day ($4,750), plus County costs ($1,077.96), pertaining to a pool with green water-algae. The property was brought into compliance on December 1, 2009. A Certificate of Title was recorded on July 18, 2013, conveying the property to the current owner, GSR Mortgage Loan Trust. Specialized Asset Management, LLC, has requested this release on behalf of the owner. Pursuant to the Board's Resolution No. 2012-46, Code Enforcement liens and fines on a property that has new ownership, fines that accrued prior to transfer of title and thirty days following transfer of title can be considered for waiver as long as the new owner has diligently pursued abatement and compliance has been achieved. In this case, the violation was abated several years prior to the new owner taking title. The property is in compliance, is being actively maintained, and an amount of$1,527.96 has been paid. This represents $117.96 in operational costs, $960 in county abatement costs, and $450 in fines. FISCAL IMPACT: Payment of$1,527.96 represents the County's costs and fines. If approved by the Board, accrued fines in the amount of$4,300 would be waived. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires majority vote to approve. This item conforms to the Board's policy contained in Resolution 2012-46. -KN RECOMMENDATION: That the Board waive the fines in the amount of $4,300, accept payment of$1,527.96, and authorize the Chairwoman to sign the attached release of lien. The lien secures the principal sum of Five Thousand, Eight Hundred and Twenty Seven Dollars and Ninety Six Cents, plus accrued interest and penalties, if any, and imposes certain obligations against real property situated in Collier County, Florida. Collier County, a political subdivision of the State of Florida, by execution of this Release and Satisfaction of Lien, acknowledges payment as approved by the Board of County Commissioners as satisfaction of the lien and hereby cancels said lien.
