EXECUTIVE SUMMARY Recommendation to award Contract No. 13-6138 — Lely Area Stormwater Improvement Project (LASIP), Davis Boulevard Weir and Canal Improvements to D. N. Higgins, Inc., in the amount of$1,764,929 plus a 10% contingency of$176,492.90 on the Purchase Order for a total of$1,941,421.90,Project No. 51101. OBJECTIVE: To continue with the construction of the LASIP Project with the approval of the Davis Boulevard Weir and Canal Improvements phase. CONSIDERATIONS: The LASIP SFWMD Environmental Resource Permit (#11-01140-S) was issued on October 14, 2004, and is extended each time a new construction phase is approved. However, the USACE Environmental Resource Permit SAJ-2002-2436(IP-MJD), which was issued on July 28, 2005, will expire on July 25, 2015. This project is bringing us closer to completion and compliance with these permits. Thus far, each phase has been completed successfully according to the phasing schedule. (Phasing map attached.) At this time, all of the channel segments have been constructed or are in design. The bid for the Davis Boulevard Stormwater Improvement project was advertised on June 30, 2013, in the Naples Daily News. 1815 notices were emailed to subscribers and 84 vendors downloaded the specifications. Six (6) bids were received by the August 5, 2013 due date. The bids were reviewed by the Transportation Engineering staff and the Project's Design Professional in conjunction with the Purchasing Department. The following bids were received: Contractor Bid 1 Erosion Restoration, Inc. $1,587,218.80 2 D.N. Higgins, Inc. $1,764,929.00 3 Gulf Group $1,878,668.25 4 Mitchell & Stark _ _ $1,890,645.00 5 Quality Enterprises, Inc. $2,180,390.55 6 Guymann Construction $2,312,970.00 The bids were tabulated and verified by the Purchasing Department. Erosion Restoration, Inc., was the apparent low bidder. A bid analysis was performed by Transportation Engineering staff to determine if there were any anomalies in the bids and a crucial line item in Erosion Restoration's bid appeared to be unrealistically low. Documentation from Erosion Restoration, Inc. was requested by staff to substantiate its experience in weir construction, its ability to construct the Davis Boulevard weir for the price stated in the bid, and to confirm which contracting entity would be responsible for weir construction. Packet Page-504- 12/10/2013 11.C. Staff does not recommend awarding the bid to the apparent low bidder, Erosion Restoration, Inc., because: 1. Sufficient documentation of experience in weir construction was not provided. 2. Its bid of approximately $20,000 for a weir that the Design Engineer and staff agree should cost from $80,000 to $250,000 was unrealistically low. 3. Documentation provided did not indicate clearly whether it was the current contractor or past affiliates that had constructed the structures described; different company names appear on the reports. The second bidder, D.N. Higgins, Inc., was contacted and similar documentation was requested. They complied and staff is satisfied they can accomplish the weir construction listed above. Therefore, staff recommends awarding the construction contract to the D.N. Higgins Inc., the lowest, responsive and qualified bidder. The Design Engineer's opinion of probable cost for the project was $2,122,786.00. D.N. Higgins's bid was 16.9%under the Engineer's estimate. FISCAL IMPACT: Total funding needed is $ 1,941,421.90 which includes a 10%contingency. Funds in the amount of$1,897,133.90 are available within the Stormwater Management CIP Fund (325) in project 51101. Funds in the amount of$ 44,288.00 are available in the Water Capital Fund (412)Project 70071.1.3. Source of funds are Ad Valorem and Water Capital funds. The Operations and Maintenance cost associated with the new weir would be minimal for first 5 to 7 years, and approximately $500 annually thereafter. GROWTH MANAGEMENT IMPACT: The project is in accordance with the goals and objectives of the Drainage Sub-element of the Growth Management Plan for Collier County Stormwater Management. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval.—SRT RECOMMENDATION: That the Board of County Commissioners award Contract No. 13- 6138 to D.N. Higgins, Inc. in the amount of $1,764,929.00 for the construction of the Davis Boulevard Weir and Stormwater Improvements project, authorize the bid amount plus a 10% contingency on the Purchase Order, and authorize the Chairwoman to sign the attached contract after final review by the Office of the County Attorney.
