EXECUTIVE SUMMARY
Recommendation to adopt a Resolution amending Resolution 84-79 in order to correct a scrivener's
error found in the legal description of the vacated portion of platted Tenth Street East in
Immokalee, Florida located in Section 3, Township 47 South, Range 29 East, Collier County,
Florida.
OBJECTIVE: To adopt a Resolution correcting a scrivener's error found in the legal
description of the vacated road right-of-way as depicted in Exhibit"A" of Resolution 84-79.
CONSIDERATIONS: On April 18, 1984, the Board of County Commissioners (Board)
approved Resolution No. 84-79 as recorded in Official Record Book 1077, Page 1625 of the
Public Records of Collier County, Florida to vacate 60-feet of right-of-way platted as Tenth
Street East in Immokalee, Florida. Per the 1984 application, the intent was to vacate Tenth
Street East (80-foot right-of-way) lying Northerly of Block 57, Southerly of Block 55, Westerly
of Tenth Street East, and easterly of Ninth Street East as shown on the plat of Newmarket
Subdivision,recorded in Plat Book 1, Page 104 of the public records of Collier County, Florida.
As a result, Bradley Stockham, as agent for the property owner, applied to correct the scrivener's
error found in the legal description of Resolution No. 84-79 to vacate the full 80 feet of right-of-
way intended in the original application.
FISCAL IMPACT: Growth Management Division, Engineering Services staff will collect
approximately $35.50 fee from the petitioner which covers the County's cost of recording.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: This item as been reviewed as to form and legality and
requires a majority vote for approval.—ERP
RECOMMENDATIONS: To adopt a Resolution that corrects a scrivener's error found in the
legal description vacating a portion of platted Tenth Street East in Immokalee, Florida, being a
part of Resolution No. 84-79, recorded in Official Record Book 1077, Page 1625 of the Public
Records of Collier County, Florida, located in Section 3, Township 47 South, Range 29 East,
Collier County, Florida; and
Direct the Clerk to the Board to record a certified copy of the Resolution in the Public Records,
and to make proper notation of this Resolution on the plat recorded in Plat Book 1, Page 104.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA AMENDING EXHIBIT "A" OF
RESOLUTION 84-79 TO CORRECT A SCRIVENER'S ERROR FOUND IN
THE LEGAL DESCRIPTION OF THE VACATED PORTION OF TENTH
STREET EAST IN IMMOKALEE, FLORIDA, RECORDED IN OFFICIAL
RECORD BOOK 1077, PAGE 1625 OF THE PUBLIC RECORDS OF
COLLIER COUNTY, FLORIDA, LOCATED IN SECTION 3, TOWNSHIP
47 SOUTH, RANGE 29 EAST, COLLIER COUNTY, FLORIDA.
WHEREAS, the Board of County Commissioners of Collier County, Florida, on April
18, 1984 approved Resolution No. 84-79 for recording; and
WHEREAS, Resolution No. 84-79 contained a scrivener's error in the legal description
which described Tenth Street East as a 60-foot right-of-way; and
WHEREAS, the correct width of the road right-of-way is 80 feet; and
WHEREAS, Bradley Stockham, as agent for the property owner of the subject property,
has requested the Board of County Commissioners to amend Resolution 84-79 to correct the
legal description as it was originally intended and to renounce ownership of the same.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,FLORIDA, that:
This Resolution amends Exhibit "A" of Resolution 84-79 to correct a scrivener's error as
follows:
The Eiehty (80) Sixty (60) foot right-of-way, platted as Tenth Street East, now
known as Jefferson Avenue, lying northerly of Block 57, southerly of Block 55,
westerly of Tenth Street East, and easterly of Ninth Street East, now known as
Jerome Drive.
BE IT FURTHER RESOLVED that the property described in the amended Exhibit "A"
is hereby vacated, extinguished, renounced and disclaimed.
BE IT FURTHER RESOLVED that the Clerk to the Board is hereby directed to record
a certified copy of the Resolution in the Public Records and to make proper notation of this
resolution on the plat of Newmarket Subdivision, Plat Book 1, Page 104.
