A RESOLUTION SUPPORTING LEGISLATION TO RATIFY AND
CONFIRM THE CREATION OF COUNTY WATER-SEWER DISTRICT
AND TO VALIDATE THE ISSUANCE OF $6. 3 MILLION SEWER
REVENUE BONDS.
WHEREAS, on November 4, 1969 the voters of coastal
• Collier County overwhelmingly approved the creation of a
water-sewer district pursuant to Chapter 153, Part II,
Florida Statutes, and in the 8 years following said election
the Board of County Commissioners has in good faith attempted
to carry out the purposes for which the District was formed,
to-wit, causing to be made studies and plans for the provi-
sion of water and sewer services within the District, financing
and constructing water and sewer treatment and distribution
facilities and the validation of bonds for same, entering
into and administering agreements with the City of Naples
for the provision of water and sewer services in portions of
the District, and the regulation of private purveyors water
•
and sewer services within the District, and
WHEREAS, on December 23, 1977 the Supreme Court of •
Florida declared that County Water-Sewer District was not '
validly created because of the failure of the Board of
County Commissioners to publish the notice required by
Section 153.58(1) Florida Statutes, and
WHEREAS, said decision casts doubt upon the previous
bonds and contractual obligations of the District, and •
prevents the validation of the revenue bonds sought to be
validated in said Supreme Court case, and
WHEREAS, the sewer system for which said bonds were
sought to be validated is constructed and in operation, and •
further and unnecessary delay in the validation of said
bonds will result in increased costs to the users of said
sewer system solely as a result of increased interest costs;
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COI•E-IISSIONERS that this Board does fully support the special

legislation being submitted to the Collier County Legislative
• Delegation and urges that said legislation be enacted and
signed into law as early as possible in the 1978 Legislative
Session.
