EXECUTIVE SUMMARY
Recommendation to approve a Cooperative Agreement #18-7331-PB with Creative Bus Sales, Inc.,
for the purchase of two (2) trolleys using the Lee County Public Transit Trolleys Request for
Proposals (RFP) 170058LAC for the Collier Area Transit (CAT) System and execute the
Agreement and Notice of Assignment of Option.
OBJECTIVE: To acquire two (2) trolleys to expand the CAT bus fleet for the use on seasonal routes.
CONSIDERATION: On September 26, 2017 the Board of County Commissioners (Board) approved
the submittal of the grant application and execution of the award for FY17 FTA 5307 grant in the amount
of $2,469,778.00 in the Transit Award Management System (TrAMS) by the Public Services Department
Head who serves at the Board of County Commissioners designee. On March 13, 2018, the Board
approved the submittal of a revised FY17 FTA 5307 grant application to provide for the purchase of up to
2 -23' Trolley buses to be used for seasonal route service. In coordination with colleagues in Le e County,
staff received information regarding the recent procurement conducted for Trolleys for use on Lee’s
transit system. Lee County’s RFP solicited proposals for 23’ Trolley buses meeting the required Federal
Transit Administration (FTA) Bus Testing Program. After two (2) separate solicitations, Creative Bus
Sales was the single bidder awarded the contract at $205,381 per bus. The Lee County solicitation had a
public agency cooperative purchasing clause, which would allow CAT to purchase two (2) buses with the
available grant funds allocated for this project.
After this independent research, staff found the Lee County trolley procurement to be fair and reasonable
as it resulted in a bid that was very competitive compared with buses with similar equipment that
complies with FTA guidelines. Additionally, Lee County conducted a thorough inquiry with the
manufacturers that downloaded the solicitation to find that the limited number of manufacturers with
tested trolleys that meet the FTA Bus Testing Program was the reason for the single response. Conducting
a separate procurement was not contemplated by staff because it could not be completed within the time
constraints of the operational need due to the complexity of the scope and contract.
Staff requests approval of this cooperative and to enter into a contract with Creative Bus Sales, Inc., for
the purchase of two (2) 23’ trolleys using Lee County Public Transit Trolleys RFP 170058LAC. On
August 22, 2017, Lee County signed a contract with Creative Bus Sales, Inc., for the purchase of public
transit trolleys. CAT will be using this RFP for the purchase of two (2) trolleys. Staff will do separate
procurements for the Intelligent Transportation System (ITS) and two-way radios for these trolleys while
they are in production. The estimated cost for the ITS and radios is $33,000 per trolley.
Procurement Division staff has reviewed the Lee County solicitation terms and conditions and believes it
is in the best economic interest of Collier County and is consistent with Section 18 of the Board of
County Commissioners (Board) Procurement Ordinance No. 2017-08, as amended. The Grants
Management Office has also reviewed the procurement solicitation process for grant compliance and
finds it compliant with the FTA Circular 4220.1E for "Third Party Contracting Requirements."
FISCAL IMPACT: The purchase of two (2) small trolleys, ITS, and two-way radios in the total amount
of $476,762 is planned and programmed with FTA5307 Grant in Fund (424), Project 33526 and the
Mercato PUD Fund (426), Project 60133. Bus purchase was included in the Program of Projects at the
time of revised grant application, which was taken to the Board on March 13, 2018.
LEGAL CONSIDERATIONS: This Item is approved as to form and legality, and requires majority vote

GROWTH MANAGEMENT IMPACT: Consistent with Objectives 10 and 12 of the Transportation
Element of the Growth Management Plan.
RECOMMENDATION: To approve a Cooperative Agreement #18-7331-PB with Creative Bus Sales,
Inc., for the purchase of two (2) trolley buses utilizing Lee County Public Transit RFP 170058LAC and
authorize the Chairman to sign said Agreement and Notice of Assignment of Option.
