EXECUTIVE SUMMARY
Recommendation to approve a Certification of Financial Responsibility, as required by the Florida
Department of Environmental Protection, for the transfer of the operating permit for the deep
injection well system for the Golden Gate Water and Wastewater Treatment Plants.
OBJECTIVE: To certify unconditionally to the Florida Department of Environmental Protection
(FDEP) the county’s obligation to perform plugging and abandonment of the deep injection well system
for the Golden Gate Water and Wastewater Treatment Plants (WTP and WWTP) pursuant to Chapter 62 -
528 Florida administrative code.
CONSIDERATIONS: The purpose of deep injection well IW-1 and monitoring well DZMW-1 is to
dispose of the blended treated wastewater effluent and demineralization concentrate produced by the
Golden Gate WWTP and WTP treatment processes. While the Golden Gate WTP is currently not
producing potable water, the permit continues to include this component for operational flexibility.

On May 15, 2017, the Florida Governmental Utility Authority (FGUA) submitted a FDEP permit renewal
application, which has been administratively continued in accordance with 64-4.090, F.A.C., pending
issuance of the permit.
Collier County acquired the Golden Gate system from FGUA on March 1, 2018. As part of the FDEP
permit transfer process, the County must complete and execute a Certification of Financial Responsibility
form (copy attached). This form certifies that the county will be unconditionally obligated to have the
financial resources necessary to close, plug, and abandon the Class I injection well and related monitoring
well. The current plugging and abandonment cost estimate is $290,243.80. FDEP will accept the
plugging and abandonment cost estimate previously submitted by FGUA with their permit renewal
application (estimate attached). In the event that the injection well system fails to meet permit conditions,
or the well is no longer required for its intended use, then plugging and abandonment become necessary.
FISCAL IMPACT: The actual expenditure of funds is not anticipated and would only be required if an
injection well was to be abandoned. Funds to cover these costs, if needed, are maintained in the Reserves
for Contingency line item in the County Water/Sewer Fund (408), which is funded through user fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
executing this document.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
RECOMMENDATION: That the Board of County Commissioners, Ex-officio the Governing Board of
the Collier County Water-Sewer District, approves and authorizes the Chair to execute the Certification of
Financial Responsibility form.

and related monitoring wells, as required by Chapter 62-528, Florida Administrative Code. It
is further understood that the cost estimate to conduct plugging and abandonment,
established on _____________________, shall be updated thirty (30) months after the date
of permit issuance and this obligation shall incorporate accumulated inflation costs. An
increase exceeding 10 percent compared with the amount stated below shall require submission
of an updated certification form.
