EXECUTIVE SUMMARY
Recommendation to approve the partial release of a code enforcement lien with an accrued value of
$687,572.47 for payment of $3,822.47 in the code enforcement actions entitled Board of County
Commissioners v. Tarpon IV LLC, Special Magistrate Case No. CEPM201000018647 relating to
property, Folio No. 39773480009, Collier County, Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to partially release a code
enforcement lien encumbering Folio No. 39773480009 for payment of $3,822.47 in relation to Code
Enforcement Board Case No. CEPM20100018647.
CONSIDERATIONS: As a result of code violations at a different property owned by Tarpon, LLC, 616
Palmetto Avenue, code liens were placed on all of the properties owned by Tarpon, LLC, at the time,
which included the subject Folio No. 39773480009. The lien was recorded in the Official Records on
September 26, 2011, at O.R. Book 4721, Page 2836.
Folio No. 39773480009 was purchased by Mr. Streames on October 1, 2013. Folio No. 39773480009 has
no code violations but was encumbered due to Tarpon IV, LLC, being the previous owner and having the
above referenced lien encumbering all the properties owned by Tarpon, LLC, at the time. Mr. Streames is
selling subject Folio No. 39773480009 and is seeking a partial release of the subject code lien as to this
Folio only. Mr. Streams has paid $3,822.47 in proposed settlement for release on this Folio and there are
no code violations on this Folio. All property owned by Tarpon IV, LLC, continues to be encumbered by
the subject code lien.
FISCAL IMPACT: Payment of $3,822.47 has been made, representing $3,710 in abatement costs and
$112.47 in operational costs. If approved by the Board, accrued fines in the amount of $683,750 would
continue to encumber all real property owned by Tarpon IV, LLC.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. - KN
RECOMMENDATION: To accept payment amount of $3,822.47, and authorize the Chairman to sign
the attached partial release of lien for recording in the Official Public Records.
