EXECUTIVE SUMMARY
Recommendation to approve a resolution amending Ordinance No. 2004-66, as amended, that
created an Administrative Code for Land Development, by amending Chapter Two, Legislative
Procedures, more specifically to amend Section B, Land Development Code Amendment - Privately
Initiated Text Amendments, to modify application procedures for privately initiated land
development code amendments; and providing an effective date.

OBJECTIVE: To obtain Board approval of the proposed amendment to the Collier County
Administrative Code for Land Development in order to modify application procedures for privately
initiated land development code amendments.
CONSIDERATIONS: Staff is bringing forth the subject Administrative Code amendment relating to
privately initiated LDC amendments to clarify existing application requirements and procedures, and to
add a requirement for a pre-application meeting for privately initiated LDC amendments.
Over the past several years, applications have been submitted for privately initiated LDC amendments for
which the proposed LDC change cannot be made or would not solve the applicant’s identified problem.
Additionally, during a recent application for a privately initiated LDC amendment, several needed
updates to the Administrative Code were identified to ensure a complete application submittal. This
Administrative Code amendment will ensure that petitioners do not unnecessarily submit and pay for
LDC amendments which cannot be accomplished, and ensure that when a privately initiated LDC
amendment is appropriate, the application, review process, and notification requirements are clear.
According to Ordinance 2004-66, as amended, changes to the Administrative Code for Land
Development should be done by Resolution. It should be noted that the proposed amendment to the
administrative code was reviewed by the Planning Commission and the Development Service Advisory
Committee.
FISCAL IMPACT: There are no fiscal impacts associated with this action.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval - SAS
RECOMMENDATION: To approve the proposed Resolution amending Ordinance No. 2004-66, as
amended, the Collier County Administrative Code for Land Development and direct staff as to any
changes.
