EXECUTIVE SUMMARY Recommendation to approve a substantial amendment for the FY2012-2013 Collier County U.S. Department of Housing and Urban Development (HUD) Action Plan replacing the City of Naples Land Acquisition Project with the City of Naples Wheelchair Accessible Play Structure project at the same cost($105,835). OBJECTIVE: Replace the HUD FY2012-2013 Action Plan project description for the City of Naples Land Acquisition project with the City of Naples Wheelchair Accessible Play Structure Project. CONSIDERATIONS: The FY2012-2013 HUD Annual Action Plan was approved at the July 24, 2012 Board of County Commissioners meeting (Item#11E). The City of Naples identified a project to acquire a parcel of land located on 5th Avenue North within its incorporated boundaries. The Board approved project scope for the City of Naples is: "The acquisition of a vacant parcel of property within the City's Community Redevelopment Area (CRA) near the River Park Community Center on 5th Avenue North at the entrance to the FPL substation." The City notified Housing, Human and Veteran Services (HHVS) that it was not able to reach agreement with the seller and would not be purchasing the property. The City requested that it be allowed to substitute another project for their entitlement funding. The City submitted a new application identifying a new project utilizing CDBG funds. The new project is described as: "The project activity is to add (installation and construction of) a new Americans with Disabilities Act (ADA) wheelchair accessible play structure (including shades, safety surfaces, installation, permitting,etc) at one of the City's small play areas across the street from the River Park Community Center. The activity will comply with the ADA on Access Board guidelines for play area components including ground level and elevated. Additionally, the activity will rely on standards from the American Society for Testing and Materials (ASTM) for wheelchair access under ASTM standard F1951-99 and impact attenuating in compliance with ASTM F 1292-99." The funding amount of$105,835 will not change. The substantial amendment was published in the Naples Daily News on June 7, 2013, with a 30-day public comment period from June 8, 2013 thru July 8,2013.No public comments were received. FISCAL IMPACT: There will be no effect on ad valorem or general fund dollars. Funds are available within the Housing Grant Fund(705)FY12/13 CDBG Project(33236.2.3). LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote. -JAB GROWTH MANAGEMENT IMPACT: There is no Growth Management Plan impact by this action.
