EXECUTIVE SUMMARY Recommendation to adopt a Resolution to hold a public hearing to consider vacating a portion of the 10-foot drainage easement, being a part of Lots 2, 3 and 4 of Lely Barefoot Beach, Unit Two, recorded in Plat Book 15, pages 71 through 72 of the Public Records of Collier County, Florida, also being a part of Section 6,Township 48 South,Range 25 East,Collier County, Florida. (Petition VAC-PL20130000419) OBJECTIVE: Pursuant to Section 177.101, Florida Statutes and Resolution 2006-160, the Board of County Commissioners must authorize a public hearing to consider the vacation of a portion of any recorded subdivision plat. CONSIDERATIONS: The Engineering Services Department has received a request from Richard Ewing of Coastal Engineering Consultants, Inc., as agent for the property owner. This request is to vacate a portion of the 10-foot drainage easement, being a part of Lots 2, 3 and 4 of Lely Barefoot Beach, Unit Two, recorded in Plat Book 15, pages 71 through 72 of the Public Records of Collier County, Florida, also being a part of Section 6, Township 48 South, Range 25 East, Collier County, Florida. The drainage easement is no longer necessary due to the fact that all drainage is being managed through the common area property, Beach Garden K, of Lely Barefoot Beach Unit Two plat. The hearing will be advertised in a local paper of general circulation pursuant to Resolution 2006-160, and the adjoining property owners will be given notice as well. FISCAL IMPACT: The application fee of$2,100.00 covers staff review and processing. The Applicant is also responsible for advertising fees. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. -ERP RECOMMENDATION: That the Board of County Commissioners endorses staff's recommendation to schedule a public hearing to consider vacating a portion of the 10-foot drainage easement, being a part of Lots 2, 3 and 4 of Lely Barefoot Beach, Unit Two,recorded in Plat Book 15, pages 71 through 72 of the Public Records of Collier County, Florida, also being a part of Section 6, Township 48 South, Range 25 East, Collier County, Florida.
