Agenda 06/25/2013 Item #16A15^` EXECUTIVE SUMMARY 6/25/2013 16.A.15. Recommendation to approve and authorize the Chairwoman to sign a Cost Share Agreement between Collier County and Forest Glen Golf & Country Club Homeowners Association in order to rovide an interim access improvement into Forest Glen. OBJECTIVE: That the Board approves the attached Cost Share Agreement which will provide Forest Glen an interim access improvement and reduce the need for U -turns on Collier Boulevard. CONSIDERATIONS: Forest Glen has continuously petitioned the County for direct access off of Collier Boulevard before, during and after the expansion of Collier Boulevard to six lanes. On January 13, 2009, Item IOB, the County denied Forest Glen's request for direct access from Collier Boulevard. County staff represented that direct access would require a reduction in the storage capacity of the dual north bound lefts into Business Circle. This reduction would impede the functional ability of the dual northbound lefts to properly manage traffic on Collier Boulevard. Staff was also concerned that the anticipated construction impact of the pending Davis Boulevard and Collier Boulevard project would further exaggerate that need. The existing construction project is coming to a close and traffic on Business Circle has not significantly increased. At the request of Forest Glen, the County conducted a follow up study on February 12, 2013 (attached). Forest Glen's engineer and the County's engineer have agreed that an interim left turn directly into Forest Glen can be accommodated as a provisional improvement. The County routinely makes these adjustments as traffic patterns adjust and as traffic volumes increase or decrease. Forest Glen had requested that the County should bare the entire cost of this modification. Since this modification is an interim solution, the parties have agreed that Forest Glen should be responsible for a portion of the cost. The County estimates the cost to be less than $100,000. Forest Glen has agreed to participate in the improvement project as follows: 1. Forest Glen will be fully responsible to provide the approved design plans. 2. The plans will be developed consistent with Exhibit A (attached) and will be reviewed and approved by the County. 3. The County will act as the construction manager of the project. 4. Forest Glen will pay 50% of the construction cost. 5. Should the Opinion of Probable Cost (OPC) exceed $110,000, either party may unilaterally terminate the agreement. 6. Forest Glen shall have the ability to review the OPC and payment to the County will be based on the OPC. 7. The County reserves the right at its sole discretion to eliminate the direct access in the future but will allow Forest Glen at its sole cost to rebuild the access farther south consistent with Exhibit B (attached). Packet Page -574- 6/25/2013 16.A.15. Staff believes this is a fair and reasonable compromise that does not jeopardize health, safety, welfare and the functional operation of Collier Boulevard. FISCAL IMPACT: The County will be responsible for up to $55,000 of construction related cost for this project. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. -JAK. C bier County GROWTH MANAGEMENT DIVISION Transportation Engineering Department Traffic Evaluation of Collier Boulevard - Forest Glen Boulevard Intersection Prepared by: Eugene Calvert, PE, PTOE February 12, 2013 This report summarizes a traffic access and impact evaluation of the intersection of Collier Boulevard (CR -951) and Forest Glen Boulevard located in Section 2, T50S, R26E, Collier County, Florida as shown in Figure 1 below. Forest Glen Boulevard provides the primary access into the Forest Glen Golf and Country Club. A secondary access is provided into Forest Glen Golf and Country Club on the north by Periwinkle Way via Beck Boulevard. Figure l Vicinity Map Collier Boulevard is six lane divided highway functionally classified as a Major Rural Collector Highway with an average daily traffic (ADT) of 32,529 vehicles per day during the peak season from December thru March. It is a major north -south corridor connecting Davis Boulevard (SR -84) / 1 -75 on the north and East Tamiami Trail (US- 41/SR -90) on the south. A major, 100+ acre retail /professional business center that includes a Wal -Mart Super store, is located west of Collier Boulevard, approximately 660 feet Packet Page -578- 6/25/2013 16.A.15. north of the Collier Boulevard / Forest Glen Boulevard intersection. The center is approximately 50% built -out and access is provided by the street of Business Circle North and South from Collier Blvd and Market Street from Davis Boulevard. Beck Boulevard is a two lane roadway functionally classified as a local street. Forest Glen Boulevard and Periwinkle Way are two -lane private roadways maintained by the community of Forest Glen Golf and Country Club. The in- season traffic volume on Forest Glen Boulevard entering the community via Collier Boulevard was measured to be 768 vehicles per day and the in- season traffic volume via a southbound U -Turn on Collier Boulevard was measured to be 548 vehicles per day. The number of vehicles entering Forest Glen via Periwinkle Way was measured to be 429 vehicles per day. When Collier Boulevard was reconstructed approximately 4 years ago from a four -lane divided highway to a six -lane divided highway, the intersection of Collier Boulevard and Forest Glen Boulevard was closed. Access from Collier Boulevard onto Forest Glen Boulevard is currently restricted to northbound right -in only. Southbound traffic desiring to turn into Forest Glen Boulevard must travel approximately 1,100 feet south of the intersection, make a u -turn, and then proceed north on Collier Boulevard to the intersection. Approximately 70% of the vehicles turning into Forest Glen Boulevard are southbound vehicles that make a u -turn. Figure 2 below is a tabulation of vehicular traffic entering into Forest Glen Golf and Country Club. It has been reported that the purpose of the relatively long left -turn lane is to accommodate future build -out of the retail /business center. Previous studies have found a maximum of 7 northbound .� vehicles in queue at any one time. Typically the maximum queue is 4 — 6 vehicles due to the protective 2 Packet Page -579- 6/25/2013 16.A.15. traffic signal phase at Business Circle. The existing traffic condition does not warrant the dual left -turn lanes at this time. Traffic Operations staff recommends allowing a southbound single left -turn lane into Forest Glen Boulevard until such time as the traffic into retail /business center to the north at Business Circle South warrants the 565 foot long dual left turn lane. When the County determines that the northbound left turn volume warrants the need for an expanded northbound left turn lanes, the County should be able to close the southbound left turn lane into Forest Glen. To construct a southbound left turn lane into .Forest Glen Boulevard, it will be necessary to modify the existing dual northbound left turn lanes. In addition, it appears that a public utilities air relief valve located in the closed median at Collier Blvd / Forest Glen Blvd may have to be modified and /or relocated. COST SHARE AGREEMENT BETWEEN THE FOREST GLEN GOLF & COUNTRY CLUB AND COLLIER COUNTY THIS AGREEMENT is made and entered into this _ day of June, 2013, by and between Collier County, a political subdivision of the State of Florida, by and through its Board of County Commissioners (hereinafter referred to as the "County "), and FOREST GLEN GOLF & COUNTRY CLUB HOA, with a principal address of 3855 Forest Glen Boulevard, Naples, Florida 34114 (hereinafter referred to as "Forest Glen ") RECITALS: WHEREAS, Forest Glen represents the collective interests of the Forest Glen Community (Community) located at 3855 Forest Glen Boulevard, Naples, Florida; and WHEREAS, the Community seeks to temporarily improve their access into their development off of Collier Boulevard (CR -951); and WHEREAS, Forest Glen and the County have reanalyzed the traffic conditions along CR -951 and have collectively agreed that a modification to the northbound dual left turn lanes on ^ CR -951 into Business Circle will not adversely impact the health, safety and welfare of the traveling public at this time; and the construction of a southbound single left turn lane directly into the main entrance of the Community will temporarily improve access and enhance safety; and WHEREAS, Forest Glen and the County anticipate that these improvements should not exceed $100,000 and have agreed to equally share in the construction cost; and also share in the design and construction management with Forest Glen taking on the design and the County taking on the construction management; and WHEREAS, the County and Forest Glen agree that this modification to the CR -951 access may or may not be permanent but should last a reasonable amount of time to justify the time and expense; and WHEREAS, after reasoned consideration by the Board of Commissioners, the Board finds that this Agreement will not adversely impact the proper function of the County's transportation system; that this Agreement will not adversely impact the health, safety and 1 Packet Page -581- 6/25/2013 16.A.15. welfare of their citizens; and that these temporary improvements provide an overall public benefit. WITNESSETH: NOW, THEREFORE, in consideration of the mutual covenants herein contained, the parties agree as follows: 1. All of the above RECITALS are true and correct and are hereby expressly incorporated herein by reference as if set forth fully below. 2. Forest Glen, at its sole cost and expense, shall design the modifications to the northbound dual left turn lanes and the southbound single left as shown on Exhibit A (hereinafter referred to as the "Project ") consistent with Florida Department of Transportation standards. 3. County shall provide a timely review of the plans and upon approval prepare an opinion of probable costs (OPC). If the OPC exceeds $110,000, either party may by written notice unilaterally terminate this Agreement. The County will submit the OPC to Forest Glen for its review, and upon its approval, Forest Glen will make payment to the County for 55% of the OPC within 120 days. This payment shall be kept in a separate account. County will commence construction of the Project within 180 days of receiving payment. Upon completion of the Project, County shall provide Forest Glen with an accounting of the actual cost of the Project. If, and only if, the actual costs exceed the OPC, Forest Glen shall have ten business days to dispute this final accounting. Should no dispute be filed within this time frame, County shall deduct half of the actual costs of the Project from this fund, and shall transmit the remaining balance to Forest Glen. In no event will Forest Glen be responsible for more than its payment to the County, and should actual costs exceed 110% of the OPC, County will bear the full cost of any such excess. Any dispute will be submitted to the Board of County Commissioners for adjudication. The decision of the Board shall be final. 4. In the future, should the County believe that the Project is adversely impacting the functional operation of CR -951 at Business Circle, the County at its sole discretion and cost may eliminate the southbound turn lane and return the dual northbound left turn lanes to its present configuration. Prior to doing so, the County will provide Forest Glen with a 180 day notice of n such intent before commencing construction. Within this 180 day notice period, Forest Glen at 2 Packet Page -582- 6/25/2013 16.A.15. its sole cost and expense may elect to modify the location of the southbound left turn lane further south as shown on Exhibit 11. Should Forest Glen choose this option, it .vill have 190 days after noticing the County to commence construction.
