EXECUTIVE SUMMARY Recommendation to approve an after - the -fact amendment between Collier County and the Area Agency on Aging for Southwest Florida, Inc. d /b /a Senior Choices of Southwest Florida (Senior Choices) and budget amendment that reflects a decrease of grant funding in the amount of $1,689 in the Nutritional Services Incentive Program (NSIP) for FY 2012/2013. OBJECTIVE: To continue providing meals to the frail and elderly in our community. CONSIDERATIONS: In January 2008, the Housing and Human Services Department, Services for Seniors program, received approval from the Board to begin administering the Senior Nutrition Program. The program in Collier County is partially funded through the Federal Nutritional Services Incentive Program (NSIP) and currently consists of congregate meal sites in East Naples, Golden Gate, Goodlette Arms senior apartments and the Roberts Center in Immokalee. Home delivered meals are also provided to the frail, home bound, elderly through this grant program. The current NSIP agreement for FY 2012/13 in the amount of $35,146.00 was approved by the Board on December 11, 2012, item 16.D.14. The amendment decreases the total contract funding from $35,146.00 to $33,457.00. In order to decrease the funding for FY 2012/13, an amendment in the amount of $1,689.00 and the corresponding budget amendment must be approved by the Board of County Commissioners. The amendment was received from Senior Choices on April 16, 2013 and was required to be returned within 30 days. This amendment is being presented after - the -fact because it was not received by County Staff in time to meet the agenda submittal deadline for the April 23, 2013 Board meeting. In addition it could not be routed for the Chairwoman's signature until after the May 14, 2013 Board meeting. In order to remain in compliance with the terms of the grant and to continue to provide much needed services to the County's elderly, it was necessary to execute the amendment prior to the regularly scheduled Board meeting. Consequently, pursuant to Resolution No. 2010 -122 and CMA 5330, Steve Carnell, Interim Administrator, is authorized to sign the contract amendment. Collier County as the lead agency is responsible to address its senior's needs and to manage the spending authority for the NSIP program. FISCAL IMPACT: A budget amendment is necessary to reduce the current NSIP allocation by $1,689.00. NSIP funds are located in Human Services Grant Fund (707), Project 33245. No match is required. LEGAL CONSIDERATIONS: This is a standard form amendment provided by the Area Agency on Aging for Southwest Florida, Inc. d/b /a Senior Choices of Southwest Florida. This item is legally sufficient and requires a majority vote. — JBW GROWTH MANAGEMENT: There is no growth management impact from this recommendation. RECOMMENDATIONS: That the Board approve an after - the -fact amendment and attestation statement between Collier County and the Area Agency on Aging for Southwest Florida, Inc. d/b /a Senior Choices of Southwest Florida and authorize the corresponding budget amendment to decrease grant funding in the amount of $1,689 for the Nutritional Services Incentive Program (NSIP) for FY 2012/2013. DBA SENIOR CHOICES OF SOUTHWEST FLORIDA NUTRITION SERVICES INCENTIVE PROGRAM This AMENDMENT, entered into by the Area Agency on Aging for Southwest Florida, Inc. dba Senior Choices of Southwest Florida ( "Agency ") and Collier County Board of County commissioners, ( "Contractor "), amends contract NSIP 203.13. The purpose of this amendment is to decrease the contract amount by $1,689.00 and decrease the level of services accordingly. This amendment changes total contract funding from $35,146.00 to $33,457.00. Additionally, this amendment (1) revises section 4 of the Standard contract, (2) revises ATTACHMENT I, SECTION III METHOD OF PAYMENT; AND (3) revises ATTACHMENT III Exhibit 1. The purpose of this amendment is to amend the following contract sections (Paragraphs and Attachments). STANDARD CONTRACT: (1) Revises section 4. CONTRACT ATTACHMENTS: (1) Revise ATTACHMENT I, SECTION III METHOD OF PAYMENT; and (2) Revise ATTACHMENT III Exhibit 1. Line denotes completion of above summary 4. Contract Amount The Agency agrees to pay for contracted services according to the terms and conditions of this contract in an amount not to exceed $33,457.00, or the rate schedule, subject to the availability of funds. Any costs or services paid for under any other contract or from any other source are not eligible for payment under this contract.
