EXECUTIVE SUMMARY Recommendation to approve an after - the -fact amendment between Collier County and the Area Agency on Aging for Southwest Florida, Inc. d /b /a Senior Choices of Southwest Florida to amend the effective date of the unit rate increase per meal served in the Nutritional Services Incentive Program (NSIP) for FY 2012/2013. OBJECTIVE: To allow the unit rate reimbursement increase be effective October 1, 2012, which is also the effective date of the program. CONSIDERATIONS: In January 2008, the Housing and Human Services Department, Services for Seniors program, received approval from the Board to begin administering the Senior Nutrition Program. The program in Collier County is partially funded through the Federal Nutritional Services Incentive Program (NSIP) and currently consists of congregate meal sites in East Naples, Golden Gate, Goodlette Arms senior apartments and the Roberts Center in Immokalee. Home delivered meals are also provided to the frail, home bound, elderly through this grant program. The current NSIP agreement for FY 2012/13 in the amount of $35,146.00 was approved by the Board on December 11, 2012, item 16.D.17. Amendment #1 to the agreement was approved by the Board on January 22, 2013, Item 16.D.3 and increased the unit rate for Eligible Congregate and Home Delivered Meals to $.72 per unit/meal, effective February 5, 2013 (the last date signed by the parties). For Board consideration is Amendment #2 that makes the reimbursement unit rate of $.72 for each Eligible Congregate and Home Delivered Meals effective October 1, 2012, the effective date of the program. The $0.72 unit price is a supplemental amount received for each meal served under the Older Americans Act Title III congregate meal and home delivered meal programs. These additional funds can be used to increase the number of meals served in the program. Amendment #2 was received by staff on March 28, 2013 and was required to be returned to Senior Choices within 30 days. Amendment #2 is being presented after - the -fact because Amendment #2 was not received in time for it to be processed to meet the agenda submittal deadlines for the April 9, 2013 and April 23, 2013 Board meetings. In order to remain in compliance with the grant and to be able to continue to provide much needed services to the County's frail elderly it was necessary to execute the amendment prior to the regularly scheduled Board meeting. Consequently, pursuant to CMA 5330 and Resolution No. 2010 -122, the County Manager authorized Steve Carrell, Interim Administrator, to sign the contract amendment. Collier County as the Lead Agency is responsible to respond to seniors needs and to manage the spending authority for the NSIP program. FISCAL IMPACT: There is no net fiscal impact resulting from this amendment, as only the reimbursement rate is amended. The overall reimbursement funding remains the same. NSIP funds are located in Housing Grant Fund (707), Project 33245. No match is required. LEGAL CONSIDERATIONS: This is a standard form amendment provided by the Area Agency on Aging for Southwest Florida, Inc. d/b /a Senior Choices of Southwest Florida. This AMENDMENT, entered into by the Area Agency on Aging for Southwest Florida, Inc. dba Senior Choices of Southwest Florida ( "Agency ") and Collier County Board of County Commissioners. ( "Contractor"), amends contract NSIP 203.13. The purpose of this amendment is to change the effective date of Amendment 001 changing the Attachment I unit rate from $.68 per meal to $32 per meal in the following contract section(s) (Paragraphs and Attachments): ATTACHMENT I. STATEMENT OF WORK: (1) Revise section 3.1. Line denotes completion of above summary ATTACHMENT I: (1) Section 3.1 is hereby revised to read. This is a fixed rate contract.
