EXECUTIVE SUMMARY
Recommendation to approve and execute the document necessary to convey water infrastructure
located at the Collier County Landfill, 3730 White Lake Blvd., Naples Florida, to the Collier County
Water -Sewer District.
OBJECTIVE: Convey certain water infrastructure installed within an existing Utility Easement for the
purpose of operating and maintaining the conveyed water utilities.
CONSIDERATIONS: On October 9, 2012, under Agenda Item I I E (moved from 16C1), the Board of
County Commissioners approved moving forward with the construction of the Household Hazardous
Waste (HHW) building. The project is on schedule for completion this summer. The Collier County Water -
Sewer District (CCWSD) is currently providing the water utility services at the Collier County Landfill
(Landfill) and will provide the additional water utility services installed for HHW building. As a condition
to providing these additional services, the potable water and fire line facilities constructed by the County
within the existing Utility Easement shall be conveyed to the CCWSD for future services and maintenance
of the infrastructure as specified on the exhibit attached to the Utility Facilities Warranty Deed and Bill of
Sale.
Attached for reference is a location map.
The attached Utility Facilities Warranty Deed and Bill of Sale was reviewed and approved of by the County
Attorney's Office.
FISCAL IMPACT: The total cost for recording the required document will not exceed $55. Funds are
available in the Solid Waste Capital Improvement Fund (474) under Project No. 59005. The County will
also be responsible for future related utility charges.
GROWTH MANAGEMENT IMPACT: The Landfill is inventoried in the Collier County Growth
Management Plan. The conveyance of these facilities is consistent with the Growth Management Plan.
LEGAL CONSIDERATIONS: The Utility Facilities Warranty Deed and Bill of Sale to the CCWSD was
reviewed and approved of for form and legal sufficiency by the County Attorney's Office. This item
requires a majority vote for approval. - EP
RECOMMENDATION: That the Board of County Commissioners approve the conveyance of the water
utilities to the CCWSD, and authorizes the Chairwoman to execute the aforementioned document; and,
direct the County Manager or his designee to proceed to follow all appropriate closing procedures and to
record the aforementioned document in the Public Records of Collier County, Florida.

THIS INDENTURE made this day of 2013, between COLLIER COUNTY,
a political subdivision of the State of Florida, whose mailing address is c/o 3335 Tamiami Trail E.,
Suite 101, Naples, FL 34112 ,(hereinafter referred to as "Grantor"), and the BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY
AND AS THE EX- OFFICIO GOVERNING BOARD OF THE COLLIER COUNTY WATER -SEWER DISTRICT, its
successors and assigns, whose mailing address is c/o 3335Tamiami Trail E., Suite 101, Naples, FL
34112 (hereinafter referred to as "Grantee ").
WITNESSETH:
That said Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and other
good and valuable consideration to said Grantor in hand paid by said Grantee, the receipt
whereof is hereby acknowledged, has granted, bargained and sold to the said Grantee, and
Grantee's heirs, successors and assigns forever, all water, and /or utility facilities and /or system(s)
or portion(s) thereof lying in, on, over and under the following described land ( "Exhibit "A "), for
operation, relocation, installation, repair and /or maintenance of said existing and any future
facilities, systems) or portion(s) thereof, all situate and lying and being in Collier County, Florida,
to wit:

depicts the physical location of the utility systems being conveyed, together with a list of
contributory assets.)
and said Grantor does hereby fully warrant the title to said utility facilities and /or system(s) or
portion(s) thereof, be they realty, personalty, or mixed, and Grantor will defend such title against
all claims of all persons whomsoever. For the purposes of this conveyance, the utility facilities,
system(s) and /or portion(s) thereof conveyed herein shall not be deemed to convey any of the
lands described in either exhibit. Grantor and Grantee are used for singular or plural, as context
allows. A sketch or other graphic representation showing the location of the utility facilities, etc.,
being conveyed is attached as Exhibit "B ", together with a list of those utility facilities:
TO HAVE AND; TO HOLD the some unto the Grantee and its assigns, together with the
right to enter upon said land, excavate, relocate and /or take or introduce materials for the
purpose of constructing, relocating, operating, repairing and/or otherwise maintaining utility
