EXECUTIVE SUMMARY
Recommendation that the Collier County Board of County Commissioners (BCC), as the
Community Redevelopment Agency (CRA), approve an amendment to the previously approved
Disaster Recovery Initiative (DRI) grant agreement between the BCC and the CRA.
OBJECTIVE: To obtain CRA Board approval of an amendment to a subrecipient agreement that was
approved by the BCC on April 23, 2013, Agenda Item 16D3.
CONSIDERATIONS: On September 14, 2010, BCC agenda item 416(D)(7), the BCC voted to approve a
DRI grant agreement between the BCC and CRA in the amount of $3,533,124 for further implementation of
the Immokalee Stormwater Master Plan.
The attached Exhibit A -1 entitled "Contract Amendment #6, Collier County Immokalee Area Community
Redevelopment Agency (CRA), DRI /CDBG 2008" identifies the revisions to the original agreement in strike -
though/underline format. There are two modifications as follows:
1. Invoice Process — Invoices will be required once as month to entire timely and efficient processing of
invoices.
2. Project Work Plan —The Flood and Drainage Improvement line item has been reduced by $50,000.
The Resurfacing line item has been increased by $50,000.
FISCAL IMPACT: There is no net change to the dollar amount of the subject grant Agreement. Therefore,
there is no fiscal impact related to this item. Funding is available within Immokalee CRA Grant Fund (715),
Project 33130.
LEGAL CONSIDERATIONS: Although the BCC approved Contract Amendment #6 to the Subrecipient
Agreement, it was not placed before the BCC as the CRA for approval and execution by the CRA Chair. In
the future when CRA staff seeks CRA Board approval to apply for grants administered by the County's
Housing , Human and Veteran Services Department it will also seek authorization for the CRA Chair to
execute the Subrecipient Agreement. Housing, Human, and Veteran Services Department staff will
continue to schedule Subrecipient Agreements for Board of County Commissioner consideration. This item
is legally sufficient and requires a majority vote. - JBW
GROWTH MANAGEMENT IMPACT: This grant opportunity furthers the programs and projects within
budgetary and policy guidance for the CRA and BCC of Policy 4.2 of the Future Land Use Element of the
Growth Management Plan which reads as follows: "The Immokalee Area Master Plan addresses
conservation, future land use, population, recreation, transportation, housing, and the local economy. Major
purposes of the Master Plan are coordination of land uses and transportation planning, redevelopment or
renewal of blighted areas and the promotion of economic development."
RECOMMENDATION: Recommendation to the Collier County Board of County Commissioners (BCC),
as the Community Redevelopment Agency (CRA), approve the attached amendment to the previously
approved Disaster Recovery Initiative (DRI) grant agreement.

This amendment, dated April 23, 2013 to the referenced agreement shall be by and between the parties to the
original Agreement, the Collier County Immokalee Area Community Redevelopment Agency, (to be referred to
as Subrecipient) and Collier County, Florida, (to be referred to as "COUNTY ").

THE SUBRECIPIENT AGREES TO:
IV. CONSIDERATION AND LIMITATION OF COSTS
The SUBRECIPIENT shall be reimbursed by the COUNTY using CDBG /DRI funding for
allowable costs, determined by COUNTY, in an amount not to exceed Three Million, Five Hundred
Thirty Three Thousand, One Hundred Twenty Four Dollars ($3,533,124.00) for the services described
in Exhibit "A."
All improvements specified in Exhibit "A" shall be performed by SUBRECIPIENT employees,
or shall be put out to competitive bidding under a procedure acceptable to the COUNTY and Federal
requirements. The SUBRECIPIENT shall enter into contract for improvements with the lowest
responsive and qualified bidder. Contract administration shall be handled by the SUBRECIPIENT and
monitored by HHVS, which shall have access to all records and documents related to the project.
The County shall reimburse the SUBRECIPIENT for the performance of this Agreement upon
completion or partial completion of the work tasks as accepted and approved by HHVS pursuant to the

Invoices for work performed are required every month. If no work has been performed during that
month or if the SUBRECIPIENT is not yet prepared to send the required backup, a $0 invoice will be

Payments shall be made to the SUBRECIPIENT when requested as work progresses but. not more

frequently than once per month. Final invoices are due no later than 90 days after the end of the
agreement. Work performed during the term of the program but not invoiced within 90 days without
written exception from the Grant Coordinator will not be reimbursed No payment will be made until
approved by HIIVS for grant compliance and adherence to any and all applicable local state or
Federal requirements. Payment will be made upon receipt of aproperly completed invoice and in
compliance with X218.70, Florida Statutes otherwise known as the "Local Government Prompt
Payment Act."
