EXECUTIVE SUMMARY Recommendation to approve the release of lien in the amount of $87,868.25 for payment of $1,418.25, in the Code Enforcement Action entitled Board of County Commissioners vs. Curtis D. Blocker & Curtis Blocker, Jr., Code Enforcement Case Number 2003091169, relating to property located at 423 Taylor Road, Collier County, Florida. OBJECTIVE: That the Board of County Commissioners (Board) accept an offer to release a $87,868.25 code enforcement lien, for payment of $1,418.25, in relation to Code Enforcement Board case number 2004 -008. CONSIDERATIONS: As a result of code violations at 423 Taylor Road, the Code Enforcement Board ordered the imposition of a lien ( "Lien ") against the owners Curtis D. Blocker & Curtis Blocker, Jr. in Code Enforcement Case'Number 2004 -008. The Lien was recorded in the Official Public Records on September 8, 2004, at O.R. Book 3637, Page 3698, and the Lien encumbers all real property owned by Curtis D. Blocker & Curtis Blocker, Jr.. The fine amount of $86,900 is based on accrued fines for the non - compliance period of 869 days at $100 per day pertaining to improvements made to property without obtaining the required Collier County Site Improvement Plan, Collier County building permits, inspections and Certificate of completion. The property was brought into compliance on June 10, 2008. Pursuant to Resolution 2012 -46, the property owner has retained ownership throughout the duration of the code case, pursued compliance and consistent with established practice, is eligible for a full waiver of fines. The owner has paid the operational cost of $968.25 and fines for administrative costs of $450 for consideration by the Board to release the Lien. FISCAL IMPACT: Payment of $1,418.25 represents the County's costs and fines. If approved by the Board, accrued fines in the amount of $86,450 would be waived. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item is legally sufficient for Board action and requires a majority vote for approval. Please note that this matter has nothing to do with the recently concluded Jerry Blocker litigation or property involved in such litigation. -JW RECOMMENDATION: That the Board waive the fines in the amount of $86,450, accept payment of $1,418.25 and release the Lien, and also authorize the Chairwoman to sign the attached release of Lien.
