Should a hearing be held on this item, all participants are required to be sworn in. Recommendation to approve extensions for completion of subdivision improvements associated with the Moorgate Point subdivision (AR -7618) and Classics Plantation Estates, Phase Three subdivision (AR -7433) pursuant to Section 10.02.05 B.11 of the Collier County Land Development Code. OBJECTIVE: To approve extensions for the completion of subdivision improvements associated with Moorgate Point and Classics Plantation Estates, Phase Three. CONSIDERATIONS: On December 13, 2005, and January 24, 2006, the Board of County Commissioners (Board) approved the final plats of Moorgate Point, and Classics Plantation Estates, Phase Three respectively for recording. Section 10.02.04 B.3.b of the Land Development Code requires that upon approval by the Board, a plat must be recorded within 18 months and the associated subdivision improvements must be completed within 36 months unless an extension is formally requested and granted by the Engineering Services Department. On March 6, 2006, the plat for Classics Plantation Estates, Phase Three was recorded in Plat Book 45, Pages 28 through 33. On November 17, 2006 the plat for Moorgate Point was Zn recorded in Plat Book 47, Pages 64 through 67. The developer requested and has been granted previous extensions for completion of the improvements. The projects are both within the Lely Resort Planned Unit Development (PUD), and both projects are being developed by Stock Development. The developer failed to request an extension approval for Moorgate Point prior to December 13, 2012, and for Classics Plantation Estates, Phase Three prior to January 24, 2013. Had the extension requests been submitted, the approvals of the requests would have been perfunctory. Collier County has now received a request for extensions from December 13, 2012 through December 13, 2013, for Moorgate Point, and from January 24, 2013 through January 24, 2014 for Classics Plantation Estates, Phase Three. The developer has paid the appropriate fees for the one -year extensions. There are currently Performance Bonds in place to guaranty the completion of the required subdivision improvements. FISCAL IMPACT: The County will realize revenues as follows: Fund: Growth Management Fund 131 Agency: County Manager Cost Center: 138327 — Growth Management Revenue generated by this project: Total: $300.00 Extension Fees LEGAL CONSIDERATIONS: This item has been approved by the County Attorney's Office, is legally sufficient, and requires a majority vote for approval. — ERP Packet Page -1116- 5/14/2013 16.A.9. GROWTH MANAGEMENT IMPACT: There is no growth management impact. RECOMMENDATIONS: 1. That the Board accept the applicant's extension requests together with the appropriate back fees. 2. Approve the extensions for Moorgate Point (AR -7618) and Classics Plantation Estates, Phase Three (AR -7433) so that the developer may be in compliance with the requirements of the Land Development Code. To date. the project has received a Conditional Final Acceptance for all paving & drainage subdivision improvements, and Final Acceptance for all water and sewer improvements. We currently have four (4) vacant lots remaining in the community. We continue to aggressively market the community and expect to reach buildout within 2-3 months and pursue Final Acceptance shortly thereafter. Please note that Collier County currently has 5103,895.25 in performance security posted for infrastructure improvements, which are in excess of the actual cost to complete.
