EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to authorize the
Clerk of Courts to release a cash bond in the amount of $6,312.60 which had been posted as
security for clearing associated with the Saturnia Lakes subdivision (AR- 2071).
OBJECTIVE: To return the funds associated with a cash bond based on the completed work.
CONSIDERATIONS: The Engineering Services Department routinely accepts various forms of
performance security to ensure the completion of certain improvements. On September 26,
2001, G.L. Homes of Naples, the developer of Saturnia Lakes posted a cash bond in the amount
of $6,312.60 to ensure stabilization of cleared areas within the area of their sales facility. The
developer has fulfilled his commitments and a satisfactory inspection has been completed.
Although the work was completed and inspected in 2005, the developer had never followed
through and requested release of the security until this time.
FISCAL IMPACT: There is no fiscal impact. The funds have been placed in a "Refundable
Deposit Account" anticipating completion of the improvements and returning the security.
LEGAL CONSIDERATIONS: This item has been approved by the County Attorney's Office,
is legally sufficient, and requires a majority vote for approval. - ERP
GROWTH MANAGEMENT IMPACT: There is no growth management impact.
RECOMMENDATION: Authorize the Clerk of Courts to refund the cash bond in the amount
of $6,312.60 (AR -2071) to the developer.
