Agenda 04/23/2013 Item #16A 54/23/2013 16.A.5. EXECUTIVE SUMMARY Recommendation.to approve an extension for completion of subdivision improvements associated with the Reflection Lakes at Naples Phase 3G subdivision (AR -7776) pursuant to Section 10.02.05 B.11 of the Collier County Land Development Code. OBJECTIVE: To approve an extension for the completion of subdivision improvements associated with the Reflection Lakes at Naples Phase 3G subdivision. CONSIDERATIONS: On March 14, 2006, the Board of County Commissioners, (Board) approved the final plat of Reflection Lakes at Naples Phase 3G for recording. Section 10.02.04 B.3.b of the Land Development Code requires that upon approval by the Board, a plat must be recorded within 18 months and the associated subdivision improvements must be completed within 36 months unless an extension is formally requested and granted by the Engineering Services Department. On March 28, 2007 the plat for Reflection Lakes at Naples Phase 3G was recorded in Plat Book 48, Pages 54 through 55. The developer requested and was granted a previous extension for completion of the improvements. The developer failed to request an extension approval prior to March 14, 2012. Had the extension request been submitted, the approval of the request would have been perfunctory. Collier County has now received a request for extensions from March 12, 2012 through March 14, 2014. The developer has paid the appropriate fees for two years worth of extensions. There is currently a Performance Bond in place to guaranty the completion of the required subdivision improvements. FISCAL IMPACT: The County will realize revenues as follows: Fund: Growth Management Fund 131 Agency: County Manager Cost Center: 138327 — Growth Management Division Revenue generated by this project: Total: $300.00 Extension Fees GROWTH MANAGEMENT IMPACT: There is no growth management impact. LEGAL CONSIDERATIONS: This item has been approved by the County Attorney's Office, is legally sufficient, and requires a majority vote for approval. - ERP RECOMMENDATIONS: 1. That the Board accept the applicant's extension request together with the appropriate back fees. Packet Page -593- 4/23/2013 16.A.5. 2.
