EXECUTIVE SUMMARY
Discussion of the Clerk of Court's audit of the Blocker's legal fees in reference to the
settlement agreement.
OBJECTIVE: To assure that there is a proper and complete accounting for the expenditure of
$532,831.07 of tax payers funds paid to the Blockers.
CONSIDERATIONS: On February 26, 2013, by a vote of 3 -2, the Board of County
Commissioners approved the payment of up to $540,000 and other considerations regarding
settlement negotiations and litigation expenditures in the pending cases of. Jerry Blocker et. al. v.
Collier County, Case No.08- 9355 -CA and Collier County v. Jerry Blocker et al. Case No. 09-
1281 -CA in the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, FL.
The settlement required the Blockers to submit "invoices and proof of payment in support ... of
their actual out of pocket costs and legal fees directly incurred," but not to exceed $540,000. The
Clerk of Courts was asked to review the Blocker's actual out of pocket costs and legal fees and
proof of payment. The Clerk's response to a public records request does not provide sufficient
information to determine if the Blockers provided adequate proof of payment for all expenses.

LEGAL CONSIDERATIONS: TBD
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the Clerk and the Board of County Commissioners require the
Blockers to submit proof of payment of all invoices as specified in the settlement agreement.
