EXECUTIVE SUMMARY
Recommendation to reject Invitation to Bid (ITB) #12 -5962 Forest Lakes MSTU Sidewalk, Lighting
& Landscape Beautification Project
OBJECTIVE: To reject the bid responses as the proposals submitted exceed the budget capacity of the
Forest Lakes Municipal Service Taxing Unit (MSTU) project.
CONSIDERATIONS: On August 31, 2012, the Purchasing Department sent out 1,660 notices for Bid
412 -5962 Forest Lakes MSTU Sidewalk, Lighting & Landscape Beautification Project." One hundred
and thirty two (132) companies downloaded the bid package. The County received bids on October 29,
2012, from the following contractors: Brooks & Fruend LLC, Owen- Ames - Kimball Company, Wright
Construction Group, Inc., Stultz Inc., and Bonness Inc.
Consistent with the Forest Lakes MSTU's Advisory Committee's December 4, 2012 recommendation,
staff is recommending that all bids be rejected on the basis that all bids exceed the available funding for
capital improvements. Currently the Forest Lakes MSTU has $1,056,903.50 available in capital
improvement funds allocated for this project.
Because the solicitation was conducted without alternates that could have provided for a modification to
the bid, and because the base bid exceeds budget, the only option is to re -bid the project with a modified
reduced scope in order to meet budgetary constraints of the MSTU. The MSTU's design consultant,
Windham Studios Inc., is reviewing design alternatives for including alternates for pricing items that are
optional and awarded if deemed to fall within budget.

FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's
Office, is legally sufficient for Board action and only requires a majority vote for approval —SRT.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this Executive Summary.
RECOMMENDATION: That the Board reject bid #12 -5962 as all bids received exceed the budget
capacity of the Forest Lakes Municipal Service Taxing Unit (MSTU) project.
