EXECUTIVE SUMMARY
Recommendation to approve a Joint Motion and Stipulated Final Judgment in the amount of
$8,700 for Parcel 454RDUE, in the lawsuit captioned Collier County v. Alex D. Randolph, et al, Case
No. 17-CA-1472, required for the Golden Gate Boulevard Expansion Project No. 60145. (Fiscal
Impact: $4,500)
OBJECTIVE: That the Board approves a Joint Motion and Stipulated Final Judgment in the amount of
$8,700 concerning Parcel 454RDUE for the construction of roadway and related drainage and utilit y
improvements required for the expansion of Golden Gate Boulevard from east of Everglades Boulevard to
east of the Faka Union Canal (Segment 3 - Project No. 60145).
CONSIDERATIONS: On November 13, 2017, Collier County condemned Parcel 454RDUE and
deposited $4,200 into the Court registry as a good faith estimate of value pursuant to an Order of Taking
in the lawsuit styled Collier County v. Alex D. Randolph, et al, Case No. 17-CA-1472. Parcel 454RDUE
contains 7,740 Sq. Feet, and is required for the construction of the Project, and is a perpetual, non-
exclusive road right-of-way drainage and utility easement. An Aerial of Parcel 454RDUE is attached.
Through negotiations, the parties agreed to total compensation in the amount of $8,700. If approved, the
County will be required to pay an additional $4,500 to Respondent.
The County Attorney’s Office and Staff recommend approval of this Stipulated Final Judgment since a
better result is not anticipated at trial. Upon approval, the County Attorney’s Office will file the Joint
Motion and Stipulated Final Judgment with the Circuit Court.
FISCAL IMPACT: Funds in the amount of $4,500 will be paid from impact fees from the Golden Gate
Boulevard Expansion Project No. 60145. The primary funding source for the acquisition of right-of-way
is impact fees. Should impact fees not be sufficient within a particular project, the secondary funding
source will be gas taxes.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been prepared by the County Attorney’s Office, is
approved as to form and legality, and requires a majority vote for Board approval. - JAB
RECOMMENDATION: That the Board of County Commissioners approves the attached Joint Motion
and Stipulated Final Judgment, and authorizes the payment of funds as stated herein.
