EXECUTIVE SUMMARY
Recommendation that the Board approve and authorize the Chairman to sign an amended and
restated Landscape Maintenance Agreement (Agreement) between Collier County and the
Diamond Lake Condominium Association, Inc. for landscape, irrigation and lighting improvements
within the Piper Boulevard Right-of-Way.
OBJECTIVE: That the Board approve and authorize the Chairman to sign the attached amended and
restated Landscape Maintenance Agreement permitting landscaping, irrigation and lighting improvements
within a County right-of-way on Piper Boulevard and insuring that Diamond Lake Condominium
Association, Inc. will maintain the landscape lighting accordingly.
CONSIDERATIONS: The County entered into a Landscape Maintenance Agreement with Di amond
Lake Condominium Association, Inc. to install palm trees adjacent to the Diamond Lakes development
within the Piper Boulevard public right-of-way. The Agreement was approved by the Board at the May
24, 2011 meeting (Agenda Item 16.A.8) and recorded i n OR Book 4688, Page 677 of the Official Public
Records of Collier County. However, the Association requests to amend the Agreement to allow
installation and maintenance of landscape lighting (lighting for the trees) within the Piper Boulevard
right-of-way. The landscape lighting extends along the perimeter of the right-of-way and immediately
adjacent to the Diamond Lakes development. The agreement includes the right -of-way permit and
landscape lighting plans for the new improvements, as well as the right -of-way permit and plans for the
landscaping and irrigation from the original agreement. The lighting improvements will be installed upon
Board approval and the Association shall be responsible for maintenance.
The request was reviewed by staff and the area is not in conflict with any projects identified in the 5-year
Capital Improvement Plan. The plans were reviewed and approved by the Road Maintenance Division's
landscape architectural staff and follow applicable standards.
FISCAL IMPACT: There is no cost to Collier County associated with this proposal. Diamond Lake
Condominium Association, Inc. is responsible for all recording fees.
GROWTH MANAGEMENT IMPACT: There is no growth management associated with this
Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval-SAS.
RECOMMENDATION: That the Board approve and authorize the Chairman to sign the attached
amended and restated Landscape Maintenance Agreement between Collier County and the Diamond Lake
Condominium Association, Inc. for landscape, irrigation and lighting improvements within the Piper
Boulevard public right-of-way.
