EXECUTIVE SUMMARY
Recommendation to approve the release of two code enforcement liens with an accrued value of
$134,710.72 for payment of $910.72 in the code enforcement actions entitled Board of County
Commissioners v. Michael Slovin, Code Enforcement Board Case Nos. CESD20150013215 and
CEPM20160006034 relating to property located at 5231 19th Ct SW, Collier County, Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to release two code
enforcement liens with an accrued value of $134,710.72 for payment of $910.72 in relation to Code
Enforcement Board Case Nos. CESD20150013215 and CEPM20160006034.
CONSIDERATIONS: As a result of code violations, the Code Enforcement Board ordered the
imposition of a lien against Michael Slovin, in Case No. CESD20150013215 for code violations at 5231
19th Ct SW, consisting of a shed on property prior to obtaining Collier County building permits. The lien
was recorded in the Official Records on December 22, 2015, at O.R. Book 5226, Page 561. The lien
amount of $57,230.21 is based on 570 days of accrued fines ($100 per day from November 3, 2015
through May 25, 2017) $57,000 plus $230.21 in operational costs. The property was brought into
compliance on May 25, 2017. In Case No. CEPM20160006034 for code violations at 5231 19th Ct SW,
consisting of a vacant unsecured dwelling with a broken window (access could be gained into the unit.)
The lien was recorded in the Official Records on August 17, 2016, at O.R. Book 5304, Page 3395. The
lien amount of $77,480.51 is based on 309 days of accrued fines ($250 per day from July 4, 2016 through
May 8, 2017) $77,250 plus $230.51 in operational costs. The property was brought into compliance on
May 8, 2017.
Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when full payment
of the full lien amount would impose a severe financial hardship on the property owner. Fines accrued by
an existing owner would be considered for a waiver as long as the existing owner has diligently pursu ed
abatement and compliance has been achieved. Mr. Slovin has been determined to be totally incapacitated
by the Court. His sister/guardian has taken care of the violations and has taken on the severe hardship
with Mr. Slovin’s personal affairs as well as this property. The payment of fines would only cause her
more difficulty with no benefit to her brother. The property is being actively maintained and $910.72 has
been paid in settlement of fines. The owner is requesting a waiver of $133,800 in accrue d fines, see
attached hardship letter as required. There are no known violations.
FISCAL IMPACT: Payment of $910.72 in settlement of fines has been made, representing $450 in
fines and $460.72 in operational costs. If approved by the Board, accrued fines in the amount of
$133,800 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. - KLN
RECOMMENDATION: To waive the fines in the amount of $133,800, accept payment amount of
$910.72, release the lien, and authorize the Chairman to sign the attached release and satisfaction of lien
for recording in the Official Public Records.
