EXECUTIVE SUMMARY Recommendation to approve the ranked list of selected firms for Request for Proposal (RFP) 09- 5262 -S2 Countywide Engineering Services for Coastal Engineering Services and direct staff to bring negotiated contracts to the Board for subsequent approval with Humiston and Moore Engineers and Turrell, Hall & Associates, Inc. OBJECTIVE: To obtain approval of the Selection Committee's final rankings and to direct staff to enter into contract negotiations, for additional coastal engineering disciplines for use by County departments to facilitate operations and capital project implementation. CONSIDERATION: On December 13, 2012, the Board of County Commissioners directed staff to re- solicit for additional coastal engineering firms to augment firms already awarded contracts as a result of the Countywide Engineering contracts 09 -5262 and 09- 5262S. Purchasing staff developed a Competitive Consultant Negotiation Act (CCNA) solicitation for these services and advertised the Request for Proposal on Monday, December 17, 2012, to more than 1,000 email addresses. Eleven (11) proposals were received on the due date of January 9, 2013. One (1) of the eleven (11) firms submitting a proposal (Tetra Tech) had been awarded a contract under 09 -5262 for Coastal Zone and Environmental Services, and therefore, the Selection Committee did not review their materials. The staff selection committee of six members convened to rank and score the firms based on experience, strength, company profile and location, availability and responsiveness to the County in accordance with Florida Statute 287.055. The Selection Committee recommended ranking is as follows: 1. Humiston & Moore Engineers 2. Turrell, Hall & Associates, Inc. 3. Applied Technology & Mgmt, Inc (ATM) 3. HDR, Engineering, Inc. 5. Hans Wilson & Associates, Inc. 6. Taylor Engineering, Inc: 7. Olsen Associates, Inc. 7. The Weiler Engineering Corporation 9. Coast & Harbor Engineering 10. Cummins Cederberg, Inc. There was a clear separation between the first and second ranked firm, and the two (2) third ranked firms; therefore, staff recommends negotiating contracts with two additional firms to the previously awarded contract 09- 5262 -CZ with Humiston and Moore Engineers and Turrell, Hall & Associates, Inc. Collier County is soliciting the most qualified Engineering firm(s) to provide engineering services for various projects. These services will supplement an array of professional in -house staff. It is the intent of the County to have multiple firms under the Coastal Planning and Engineering discipline in order to provide specialized services and expertise as required. The services provided as a result of this contract will be available to all County departments and may include additional engineering services as required by the County. The contract term will be consistent with; and a supplement to, the County's Fixed Term Engineering Services contract # 09 -5262, and run through March, 08, 2014, at which time, the County intends to re -issue a new fixed term engineering agreement with this scope of work included in that solicitation. Background Collier County is located in Southwest Florida. Naples, the seat of Collier County, is about thirty (30) miles south of Fort Myers and the Southwest Florida International Airport (RSW). The full time population of Collier County is about three hundred twenty thousand (320,000) although a seasonal peak of about four hundred fifty thousand (450,000) occurs between January and April. The structure of the Collier County Government is based on the standard constitutional form of county governments in Florida. The County Government is composed of six (6) agencies, each headed by an elected official or board of elected officials. For purposes of this RFP, the Board of County Commissioners (BCC) is the agency seeking proposals for engineering services. The BCC Agency has a number of divisions who have oversight responsibility for the management, operations and capital project development including: • Growth Management Division: builds and maintains roadways, right of ways and storm water systems and plans, zones and re- zones, permits, inspects buildings, enforces code and manages coastal and environmental services; • Public Utilities Division: designs, builds and maintains potable water and re -use (irrigation quality) water and wastewater systems; operates landfill and recycling operations; • Public Services Division: operates parks and recreation system, libraries, and social services; • Administrative Services Division: provides internal services such as Facilities Management, Fleet Services, Human Resources, Information Technology, Purchasing, Risk Management, and the Bureau of Emergency Services (County fire and EMS); and • Office of the County Manager: oversees and directs Office of Management and Budget and liaison to the Board of County Commissioners and the County Attorney offices. Scope of Services The specific scope of service for this discipline may include, but not be limited to (dollars identified are for projections only and should not be construed as actual contracts to be awarded in the disciplines identified; there are no guaranteed projects or funds available at this time): Discipline: Coastal Planning and Engineering Services (anticipated annual dollars: $150,000) Packet Page -2027- 2/12/2013 16.E.2. Firms specializing in the field of marine and coastal technology and engineering include, but are not limited to: • Aspects of coastal, harbor and offshore engineering: • Studies on waves and currents; • Coastal morphology; • Estuary hydraulics; • Harbor and offshore structures; • Peer review studies; • Sand / beach erosion studies; • Applying for, or update to permits, along with providing any requirements necessary for obtaining those permits; and, • Mathematical and physical models as well as constructional aspects and environmental problems relating to these items are also included. Division Required Services The County divisions who may have need for specific engineering service specialty requirements and expertise to repair, maintain and /or build new capital - related projects are included in the description below. Public Utilities: builds and maintains potable water and re-use water, wastewater and irrigation quality (IC) systems; operates landfill and recycling operations, and requires engineering services and /or project management services for: • Wellfields; • Major water pumping and distribution systems; • Wastewater pumping and collection systems; • Irrigation quality (IQ) pumping and distribution systems; • Water and wastewater treatment facilities; • Pollution testing and control; and • County Solid Waste facilities (including, but not limited to, those related to landfill design, landfill gas management, recyclables processing, areas for storage of various solid waste materials, and other solid waste related facilities). Growth Management Services: builds and maintains roadways, right of ways and storm water systems, and requires engineering and project management services for: • Bridges; • Roadways; • Right of ways; • Sidewalk design; • Traffic control systems; • Structural review and design; • Subsurface utility exploration; • Noise studies; • Geotechnical investigation; • Roadway design; • Land and road planning; • Traffic and ITS; • Planning with FDOT District 1 Certification; • Modeling with FDOT District 1 Certification; • Transit planning; • Transportation impact fee planning; • Stormwater /surface water management system design; Packet Page -2028- 2/12/2013 16.E.2. • Geographic Information System (GIS) database control; • Natural resource; • Beach re- nourishment and coastal zone management (including construction of boat ramps and docks); and • Environmental permitting. Administrative Services: provides internal services such as Facilities Management, Fleet Services, Human Resources, Information Technology, Purchasing, and Risk Management, and requires engineering and project management services for projects in disciplines such as: • Vertical construction; • Maintenance and retrofitting of buildings; • Telephone, Internet, cable, security and other wiring; • Environmental permitting; • Emergency management; and • Water and irrigation systems. Public Services: oversees coastal boundaries and beaches, parks and recreation system, libraries, and social services, and requires engineering and project management services for: • Maintenance and retrofitting of buildings and water parks; • Maintenance and oversight of beaches; • Park and water -park and water features such as fountains engineering; and • Swimming pool engineering. General Information 2/12/2013 16.E.2. This Request for Proposal (RFP) has been issued in order to meet the requirements, timeline, goals and objectives of Collier County as defined in the Scope of Services. Firms may submit their qualifications for one or more of the identified disciplines. The County reserves the right to order such services from selected firms as may be required during said period, but does not guarantee any minimum or maximum services to be ordered during the period specified from any given firm. Work Order service assignments shall be at the sole discretion of the County. • For work orders anticipated to be less than $100.000: the department, at their discretion, may select any firm from the contracted proposers, request proposals from all firms on contract in accordance with then - current work order distribution procedures, or conduct a separate solicitation. • For work orders anticipated to be over $100,000 and up to $200,000: the department may, at their discretion, use the firm in the next rotation order, request a waiver of rotation, request proposals from all firms on contract in accordance with then - current work order distribution procedures or conduct a separate solicitation. This policy is subject to modification by the Board of County Commissioners. Should a modification be made in the current policy, the County reserves the right to modify the selection method. The contracts are classified as fixed -term Countywide Agreements for various and miscellaneous Engineering and Project Management services which will be utilized on an as- needed basis. Assignments shall be implemented with Work Orders. Work Order assignments in excess of $200,000 and /or exceeding the maximum yearly contract amount of $750,000 per firm shall be approved by the Board of County Commissioners. Should any project that is active on a work order extend past the contract termination date, that work order shall be active and extended as necessary until completion of such project. This Request for Proposal does not commit the County to award a contract, pay any costs incurred in preparing a response, or procure or contract for services. Oral interviews may be held with some or all firm(s) to assess the qualifications of the firm and, if necessary, to obtain clarification and additional information in regard to their qualifications. Selection of the qualified firm(s) will be based on information supplied for this RFP, and, if necessary, the oral interview. Firms responding to this Request for Proposal must be available for presentations and /or interviews to the Selection Committee, which may be in person or by phone as determined by the Selection Committee. 2. Evaluation and Selection Procedure Collier County will evaluate and select these Services in accordance with Florida Statute 287.055, Consultants' Competitive Negotiation Act. The County's procedure for selecting is as follows: r` 1. The County Manager shall appoint a Selection Committee to review all proposals submitted. 2. Request for Proposals issued. Subsequent to the closing of proposals, the Procurement Strategist and Project Manager shall review the proposals received and verify whether each proposal appears to be minimally responsive to the requirements of the published RFP. 4. Meetings shall be open to the public and the Procurement Strategist shall publicly post prior notice of such meeting in the lobby of the Purchasing Building at least one (1) day in advance of all such meetings. 5. The committee members shall review each Proposal individually and score each proposal based on the evaluation criteria stated herein. 6. Prior to the first meeting of the selection committee, the Procurement Strategist will post a notice announcing the date, time and place of the first committee meeting. Said notice shall be posted in the lobby of the Purchasing Building not less than three (3) working days prior to the meeting. The Procurement Strategist shall also post prior notice of all subsequent committee meetings and shall endeavor to post such notices at least one (1) day in advance of all subsequent meetings. 7. Collier County will consider all the material submitted by the Proposer and other information Collier County may obtain to determine whether the Proposer is capable of and has a history of successfully completing projects of this type, including, without limitation, additional information Collier County may request, interviews, or oral presentations. 8. The Selection Committee, as approved by the County Manager, will review, evaluate and rank all responsive proposals received from Proposers responding to this RFP. The committee members shall score each Proposal in accordance with the rating criteria set forth below and may, at their discretion, schedule presentations from any firms submitting a proposal. Consultant(s) shall have an opportunity to discuss their qualifications, approach to the project and ability to furnish services for the scope of work outlined in this solicitation during the publicly announced Selection Committee Meeting prior to the final ranking. This discussion does not preclude the County from having additional presentations by ranked firms at the County's sole discretion. 9. The Selection Committee will rank qualified firms in order of preference and by consensus using all information presented to the Committee, choose the top ranked firm and will subsequently enter into negotiations with the top ranked firm. Award of the contract is dependent upon the successful and full execution of a mutually agreed contract. 10. Negotiations shall begin with the top- ranked firm(s) in accordance with Florida Statute 287.055. 11. Upon the successful completion of negotiations, contracts will be presented to the Board of County Commissioners for approval. The County reserves the right to withdraw this RFP at any time and for any reason, and to issue such clarifications, modifications, addendums, and /or amendments as it may deem appropriate, including, but not limited, to requesting supplemental proposal information. Receipt of a proposal by the County or a submission of a proposal to the County offers no rights upon the Vendor nor obligates the County in any manner. Acceptance of the proposal does not guarantee issuance of any other governmental approvals. Proposals which include provisions requiring the granting of zoning variances shall not be considered. The firms who are determined to be qualified to meet the requirements of the scope of services will be required to sign a standard Professional Services Agreement (PSA), approved by the Board of County Commissioners (BCC) for consulting projects. All respondents to this RFP will be required, if selected to perform the work, to execute the standard PSA within twenty one (21) days of Notice of Selection for Award. Prior to making award decisions, the selection committee's will review specialty areas very closely to determine if they address the County's future requirements for engineering services. 3. Responses must be received by the time and date indicated in the advertisement in order to receive consideration by the Selection Committee. All required information must be included or submission may be deemed non - responsive. 4. Qualification Information To participate in this RFP and be eligible to receive further consideration Proposers must submit a Statement of Qualifications and Experience in the required format per Attachment 2 and agree to the terms and conditions of a standard County contract Representatives for the County will review each Statement of Qualifications and Experience and contact selected references to determine whether a Proposer has the necessary professional and financial resources to successfully implement the requirements of the County. 5. Licenses The Consultant, at time of qualifications submittal and throughout the term of the contract, shall possess the correct occupational licenses, all professional licenses or other authorizations necessary to carry out and perform the work required by the project pursuant to all applicable Federal, State and Local Laws, Statutes, Ordinances and rules and regulations of any kind. Copies of the current licenses should be submitted with the proposal indicating that the firm proposing is properly licensed to perform the activities or work included in the contract documents. The Consultant shall be licensed to operate within Collier County. 6. Prohibition of Gifts No organization or individual shall offer or give, either directly or indirectly, any favor, gift, loan, fee, service or other item of value to any County employee, as set forth in Chapter 112, Part III, Florida Statutes, Collier County Ethics Ordinance No. 2003 -53, and County Administrative Procedure 5311. Violation of this provision may result in one or more of the following consequences: a. Prohibition by the individual, firm, and /or any employee of the firm from contact with County staff for a specified period of time; b. Prohibition by the individual and /or firm from doing business with the County for a specified period of time, including but not limited to: submitting bids, RFP, and /or quotes; and, c. immediate termination of any contract held by the individual and /or firm for cause. 7. It is the intent of the County, whenever feasible, to use this agreement for the design, planning and /or execution of projects funded by County, and /or public and /or private granting agencies. The purchase of all goods and services that are funded through Federal and /or State Grant Appropriations shall be subject to the compliance and reporting requirements of the Federal /State Granting Agency. Work order assignments for CCNA contracts shall be made in accordance with the procedures described above. Following is a representative listing of additional requirements that may be imposed on contract holders. This list is not all- inclusive and is only a partial list for illustrative purposes. Specific requirements may vary from project to project, and will be fully identified in the individual work order solicitation. Vendors submitting proposals for this purchase must validate that they, and their subcontractors and partners, are not excluded from receiving Federal contracts, certain subcontracts, and certain Federal financial and nonfinancial assistance and benefits, pursuant to the provisions of 31 U.S.C. 6101, note, E.O. 12549; E.O. 12689, 48 CFR 9.404, and each agency's codification of the Common Rule for Nonprocurement suspension and debarment. American Recovery and Reinvestment Act of 2009 (ARRA) Special Terms and Conditions: The American Recovery and Reinvestment Act of 2009, Pub. L. 111 -5, (Recovery Act) was enacted to preserve and create jobs and promote economic recovery, assist those most impacted by the recession, provide investments needed to increase economic efficiency by spurring technological advances in science and health, invest in transportation, environmental protection, and other infrastructure that will provide long -term economic benefits, stabilize State and local government budgets, in order to minimize and avoid reductions in essential services and counterproductive State and local tax increases ( http:// www .recovery.gov / ?g= tontent/act) a. Registration: Section 1512 provides that first tier Contractors of ARRA funds must register with Central Contractor Registration database (CCR). CCR registration can be completed at http: / /www.ccr.gov. CCR registration must be completed before the first quarterly Section 1512 report is due. Registration must be obtained during the life of the grant funded contract. b. Reporting: Federal reporting on projects funded by the American Recovery and Reinvestment Act of 2009 (ARRA), requires vendor /contractors to report their Dun and Bradstreet number (DUNS). Vendors who do not know their DUNS number may receive more information through www.dnb.com and select "D & B D -U -N -S Number." A DUNS number request takes approximately 30 days to receive and there is no cost. Vendors will need this number if they are awarded a project with ARRA funds by Collier County. This number must be maintained through the life of the grant funded contract. Depending on the contract amount and annual gross revenues in Federal awards, vendors may also need to report the names and compensation of the five most highly compensated officers of the company. c. Buy American: Section 1605(a) of the Recovery Act directs that, subject to certain exceptions, no funds appropriated or otherwise made available for a project may be used for the construction, alteration or repair of a public building or public work unless all the iron, steel and manufactured goods used are produced in the United States. The law covers Recovery Act- funded federal contracts as well as Recovery Act - funded state and local public works projects. 3. Davis Bacon: Projects awarded as a result of this contract may be subject to federal grant requirements involving prevailing wages as described in the US Department of Labor's site http: / /www.gpo.gov /davisbacon /fl.html. Department of Transportation Disadvantaged Business Enterprise (DBE) program is intended to ensure nondiscrimination in the award and administration of DOT - assisted contracts in the Department's highway, transit, airport, and highway safety financial assistance programs. Further, Vendors / Bidders are required to enroll in the E- Verify program, and provide acceptable evidence of their enrollment, at the time of the submission of the vendor's /bidder's proposal.
