EXECUTIVE SUMMARY
Recommendation to reject all bids for Invitation to Bid (ITB) #12 -5974 for Concrete; Road
Sidewalk Curb and Floor Installation and Repairs; and authorize staff to issue a modified
ITB.
OBJECTIVE: To reject ITB #12 -5974 for Concrete; Road Sidewalk Curb and Floor Install and
Repairs and authorize staff to reissue a modified ITB.
CONSIDERATIONS: The Road and Bridge Maintenance Department is responsible for the
maintenance of Collier County's roadways and sidewalks. ITB #12 -5974 was issued October
26, 2012, soliciting vendors for fair and competitive pricing for Concrete; Road Sidewalk Curb
and Floor Install and Repairs. Notices were forwarded to 864 vendors, 78 bid packages were
downloaded and three (3) submissions were received.
Of the three (3) bids received, the low bidder, Quality Enterprises, Inc., withdrew itself from
contention after discovering an error in its quoted prices that could not be honored. County staff
deemed the next lowest bid by BQ Concrete, LLC., unresponsive due to its failure to complete
the required documents in the bid package; as well as its failure to notarize its paperwork. The
third and final bidder, Bonness Inc., submitted a bid that is more than 3 times the cost of the
original low bidder. As a result, staff recommends rejecting ITB #12 -5974, reworking the
solicitation documents and issuing a new ITB as soon as possible.
In anticipation of this bid rejection, Purchasing staff has extended the current contract, #09 -5108
per the Purchasing Policy, Section XV. D. Contract Extension: "Extension(s) of a Board -
approved contract for commodities or services may be requested by the contract manager to the
Purchasing/General Services Director in writing for a period not to exceed six (6) months
(cumulatively) and shall be subject to the same terms and conditions set forth in the initial
contract." The "Annual Contract for Concrete Sidewalk & Curb Maintenance" was extended
until July 26, 2013, or until the new contract is awarded, whichever is sooner.
FISCAL EWPACT: There is no fiscal impact in the approval of this Executive Summary.
GROWTH MANAGEMENT IMPACT: There is no growth management impact in approving
this Executive Summary.
LEGAL CONSIDERATION: This item has been reviewed and approved by the County
Attorney's Office, is legally sufficient for Board action and only requires a majority vote for
approval. —SRT.
RECOMMENDATION: That the Board of County Commissioners reject ITB #12 -5974 for
"Concrete; Road Sidewalk Curb and Floor Install and Repairs" and authorize Staff to reissue a
modified solicitation.
