EXECUTIVE SUMMARY Recommendation to execute a public utility easement in favor of the City of Marco Island to permit the City to maintain an existing wastewater line in Palm Avenue, Goodland, in connection with the turnover of privately owned utility facilities to the City. OBJECTIVE: To deliver a public utility easement in favor of the City of Marco Island over and across the Northern half of Palm Avenue, Goodland, in connection with the City's acceptance of turnover of ownership of an existing wastewater line from private to public ownership. CONSIDERATIONS: Pelican Point at Goodland, LLC ("Pelican Point"), owns approximately 1,000 linear feet of 4"sewer pipe that was installed within the Northern half of the Palm Avenue right-of-way in 2008. The pipe was installed by Pelican Point's predecessor owner under Collier County Right-of-Way (ROW) Permit 08-0325-E, and has been inspected and approved by the City of Marco Island Utility department. The pipe serves the 13-unit Coon Key Pass Fishing Village condominium at the Eastern terminus of Palm Avenue. As was originally contemplated when the subject sewer line was installed, Pelican Point and the City of Marco Island Utilities Department have reached an agreement (which is subject to City Council approval) for the City of Marco Island to take over the sewer line. The City Utility Department, however, has conditioned its acceptance of the sewer line on receipt of a public utility easement from the County. The City requires the easement because it does not believe the public dedication on the underlying plat is sufficient to encompass utility easements in favor of private and public utility providers, and is concerned that it does not confer sufficient authority for the City to enter the ROW to repair, maintain, and replace the line as needed. The City Attorney and Public Works Director have approved the form Public Utility Easement as is reflected on the attached email exchange with Pelican Point attorney William J.Dempsey. FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary. Pelican Point or the City of Marco Island will pay the expense of recording the Public Utility Easement. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney,is legally sufficient,and requires majority vote for approval. -JAK RECOMMENDATION: That the Board of County Commissioners execute the attached Public Utility Easement in favor of the City of Marco Island, and advise the City with transmittal of the executed Public Utility Easement of the City's obligations under the Collier County Construction Standards Handbook for Work Within the Public Right-of-way (available at http://www.colliergov.net/Modules/ShowDocument.aspx?documentid=24889), including the obligations to: 1. To notify the County as soon as possible by any available means in the event emergency conditions(such as a break in a gas, cable, sewer, or water line, or conditions which may endanger the public) reasonably warrant immediate action, and to apply for a right-of-way permit within 72 hours thereafter.
