EXECUTIVE SUMMARY Recommendation to authorize the purchase of NetApp hardware/software maintenance agreements rrom Terremark Advanced Data Services Division for the County's NetApp hardware/software in the amount of$132,693.06 utilizing Florida State Contract 250-000-09-1. OBJECTIVE: To procure NetApp hardware/software maintenance support using an efficient and streamlined process for the County. The NetApp is a NAS (Network Attached Storage) device that IT uses to store all BCC computer data (all files, and emails). CONSIDERATIONS: The County's Information Technology Department (IT) uses NetApp hardware/software in the County's technology infrastructure and procures maintenance support for those systems on an annual basis. Florida Statute Section 163.01, known as the Florida Inter local Cooperation Act of 1969, permits local governmental units to make efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby to provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic, population, and other factors influencing the needs and development of local communities. The statute further provides that a public agency of this state may exercise jointly with any other public agency of the state, of any other state, or of the United States Government any power, privilege, or authority which such agencies share in common and which each might exercise separately. The State of Florida has a number of technology state term contracts already established that are authorized for use by County governments. The State of Florida contracts offer public agencies products and services for firm fixed pricing and terms and conditions negotiated by the State of Florida's Purchasing Department. 4dditionally, the Federal Government's IT Schedule 70 is the largest and most widely used acquisition vehicle in the federal government providing federal, state, local and tribal government organizations access to the most fair and reasonable pricing. The IT Department requested quotations for NetApp equipment support from six (6) vendors, under the State of Florida contract 250-000-09-1, the Federal Government's GSA schedule 70, and U.S. Communities. Staff received six (6) responsive quotes, one (1) non-contract quote, three (3) No-Bid and two (2) Florida State contract. Terremark Advanced Data Services Division provided the lowest responsive quote for $132,693.06 Florida State Contract 250-000-09-1. The IT Department is requesting authorization to utilize Florida State Contract 250-000-09-1 for this purchase. This agreement leverages the purchasing power of the Florida State Contract 250-000-09-1 to provide best value pricing and terms. The IT Department has requested the quotes consistent with the Board's Purchasing Policy. The quotes have been provided to the Purchasing Department for final review and approval and attached in the County's Financial System (SAP) for pre-audit review by the Clerk's Finance Department. Staff recommends the use of this contract for the procurement of the aforementioned information technology hardware/software maintenance support at a competitive price, using an efficient and streamlined process for the County. The IT Department will issue a County purchase order, along with its standard terms and conditions to execute this order. NetApp Inc, requires the purchase of new hardware and or maintenance support from approved venders. Attached is a list of approved venders with Florida State Contract 250-000-09-1. Terremark Advanced Data Services Division was the lowest bidder from the list of approved venders. The Purchasing Director has determined, per the Board's Purchasing Policy (XIV B), that the process conducted by the Florida State contract, is competitive in the market, and that the resultant contract has Packet Page -1527- 1/8/2013 Item 16.E.1 . favorable terms to the County with respect to pricing, shipping, service and warranties, etc. In addition, the use of these established Florida State Contract 250-000-09-1 allows for the County to consolidate its purchases with other public agencies and streamline its own purchasing processes. FISCAL IMPACT: Funds of $132,693.06 are available in the Information Technology Department fiscal year 2013 budget for this purchase. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office, requires majority vote, and is legally sufficient for Board action. —CMG RECOMMENDATION: Authorize the Information Technology Department to purchase NetApp equipment maintenance support from Terremark Advanced Data Services Division for the County's NetApp equipment in the amount of$132,693.06 utilizing the Florida State Contract 250-000-09-1 as the lowest bidder from NetApp approved vendor list.
