OBJECTIVE: To keep this agreement active while payment and deliverable issues are being
discussed with HUD, in the event an amendment is needed.
CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD) Community
Development Block Grant (CDBG) program funds locally defined needs for programming and
infrastructure.
On March 26, 2013, the Board approved an agreement with the Immokalee Community Redevelopment
Agency for an economic development project to fund a key employee to operate a business development
center in order to provide technical assistance to businesses in Immokalee (Agenda item 16D6).
An amendment to this Agreement is needed to extend the completion date from November 30, 2014 to
May 31, 2015 and update the teens of reimbursement.
Community and Housing Services is requesting an extension to the FY2012 -2013 CDBG Economic
Development Micro Enterprise Assistance Project until May 31, 2015 in order to meet the National
Objectives and resolve outstanding questions to ensure that the IBDC Center Manager salary and benefits
are reimbursed.
The fourth Amendment to the Agreement provides for the following changes:
1. Extends the completion date from November 30, 2014 to May 31, 2015; and
2. Updates language in Section III - AGREEMENT AMOUNT; to address amendment extensions
FISCAL IMPACT: The proposed actions described in this executive summary have no new fiscal
impact. The funding source for the grant award is the HUD CDBG Program. The grant award for this
project is $61.087 and it is budgeted in Housing Grants Fund (705) for Project No. 33236.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote for Board action. -JAB
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to
this action.
RECOMMENDATION: That the Board of County Commissioners approves and authorizes the
Chairman to sign the Fourth Amendment to the Agreement with the Immokalee Community
Redevelopment Agency for the CDBG Economic Development Assistance Project in order to extend the
completion date and update reimbursement language.

This Amendment is entered into this day of , 2014, by and
between the "Collier County Redevelopment Agency - Immokalee ", a public entity created by Collier
County pursuant to Chapter 163, Florida Statutes existing under the laws of the State of Florida, herein
after referred to as SUBRECIPIENT and Collier County, Florida, hereinafter to be referred to as
"COUNTY," collectively stated as the "Parties."
RECITALS
WHEREAS, on March 26, 2013, the COUNTY entered into an Agreement providing for
Community Development Block Grant Program (CDBG) funds to be used to provide funding for a key
employee in the Immokalee Business Development Center to provide assistance to businesses in the
Immokalee Community, hereinafter referred to as the "Agreement"; and
WHEREAS, the Agreement has been amended on December 10, 2013, February 25, 2014, and
May 27, 2014.
WHEREAS, the Parties desire to further amend the Agreement to extend the project to May 31,
2015, update the department name and budget language in Section III Agreement Amount.
NOW, THEREFORE, in consideration of foregoing Recitals, and other good and valuable
consideration, the receipt and sufficiency of which is hereby mutually acknowledged, the Parties agree to
amend the Agreement as follows:

All references throughout the agreement to Housing, Human and Veteran Services (HHVS) shall
hereinafter be replaced with Community and Human Services (CHS).
II. TIME OF PERFORMANCE
Services of the SUBRECIPIENT shall start on the 11th day of December, 2012 and end on the
30th day of NovembeF, 2014 31st day of May, 2015. The term of this Agreement and the provisions
herein may be extended by amendment to cover any additional time period during which the
SUBRECIPIENT remains in control of CDBG funds or other CDBG assets, including program income.
III. AGREEMENT AMOUNT
The COUNTY agrees to make available SIXTY ONE THOUSAND EIGHTY SEVEN
DOLLARS ($61,087) for the use by the SUBRECIPIENT during the Term of the Agreement
(hereinafter, the aforestated amount including, without limitation, any additional amounts included thereto
as a result of a subsequent amendment(s) to the Agreement, shall be referred to as the "Funds ").

will be required. Explanations will be required if two consecutive months of $0 invoices are submitted.
Payments shall be made to the SUBRECIPIENT when requested as work progresses butt not more
frequently than once per month. Reimbursement will not occur if SUBRECIPIENT fails to perform the
minimum level of service required by this Agreement. Final invoices are due no later than 90 days after
the end of the agreement, with the exception of retainage which may be held beyond of the agreement
until all deliverables are met. Work performed during the term of the program but not invoiced within 90
days without written exception authorization from the Grant Coordinator will not be reimbursed. The
County Manager or designee may extend the term of this Agreement for a period of up to 180 days. The
extension must be authorized prior to the expiration of the Agreement. The extension must be authorized
in writing by formal letter to the Subrecipient. No payment will be made until approved by CHS for grant
compliance and adherence to any and all applicable local, state or Federal requirements. Payment will be
made upon receipt of a properly completed invoice and in compliance with &218.70, Florida Statutes,
otherwise known as the "Local Government Prompt Payment Act."
