EXECUTIVE SUMMARY Recommendation to approve a substantial amendment to the U.S. Department of Housing and Urban Development Community Development Block Grant FY2014 -2015 HUD Annual Action Plan and approve a subrecipient agreement amendment to increase the existing agreement by 594,685 for a total of $175,144 for the City of Naples Intersection Improvements. OBJECTIVE: To expend the County's entitlement allocation for community amenity projects. CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) program funds locally defined the needs for programming and infrastructure. The Board approved the FY2014 -2015 Annual Action Plan on June 24, 2014, and has amended it since that time. This amendment is adding two new projects for the City of Naples. In the FY2014 -2015 Action Plan, the City did not identify a project on which to spend its entitlement funds. The City has two FY2013- 2014 intersection improvement projects Goodlette -Frank Road and 5th Avenue North and Goodlette- Frank Road and Central Avenue that, when bid, came in over the FY2013 -2014 allocated funding amount. The City is requesting that its FY2014 -2015 allocation be combined with its FY2013 -2014 allocation to complete the intersection improvements identified above. The following changes add two new projects to the FY2014 -2015 HUD Annual Action Plan, as amended: City of Naples — CDBG — 5''' Avenue North - The Action Plan indicated that a project would be identified at a later date. Project scope shall be amended to read: "Fund intersection improvements at Goodlette -Frank Road and 5th Avenue North in order to improve pedestrian safety "; Project Level Accomplishments: 1; Proposed Outcome: Public Facility; Matrix Code: 03K Street Improvements 570.201(c); Proposed Amount: $50,706 (Funds are combined with FY2013 -2014 funds to complete the project). City of Naples — CDBG — Central Avenue - The Action Plan indicated that a project would be identified at a later date. Project scope shall be amended to read: "Fund intersection improvements at Goodlette -Frank Road and Central Avenue in order to improve pedestrian safety "; Project Level Accomplishments: 1; Proposed Outcome: Public Facility; Matrix Code: 03K Street Improvements 570.201(c); Proposed Amount: $43,979 (Funds are combined with FY2013 -2014 funds to complete the project). HUD regulations and the Five -Year HUD Consolidated Plan require citizen participation whenever a substantial plan amendment is proposed. The required notice was published in the Naples Daily News on October 3, 2014. The advertisement identified a thirty -day public comment period from October 3, 2014 to November 3, 2014. As of the agenda publication, no comments regarding the substantial amendment were received. The City of Naples will consider the subrecipient agreement amendment during the regular scheduled City Council meeting on November 19, 2014. Should the City Council decide to revise the amendment, Community and Human Services staff will bring the City's revisions to the Board for review and approval. Staff has completed a compatibility analysis for the attached subrecipient agreement between the Consolidated Plan, the subrecipient's grant application, the FY2014 -2015 Action Plan and amendments, Packet Page -1522- 11/18/2014 16.D.5. Priority Needs Category and the subrecipient's scope of work for the development of the subrecipient agreement. Board approval of the subrecipient agreement confirms the basis upon which payment is to be made; why may only change thereafter by Board approved substantial amendment and /or contract amendment, if needed. Staff confirms that the projects are consistent with the Consolidated Plan and the FY2014 -2015 HUD Annual Action Plan. FISCAL IMPACT: The proposed actions described in this executive summary have no new fiscal impact. The funding source for the grant award is the Community Development Block Grant (CDBG) Program. The grant award for these projects is being increased by $94,685 for a total project cost of $175,144. It is budgeted in the Housing Grants Fund (705) for Project No. 33364 (CDBG Grants). LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for approval. - JAB GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this substantial amendment will further the Goals, Objectives, and Policies of the Growth Management Plan. The SUBRECIPIENT is required to submit quarterly progress reports. SUBRECIPIENT may not request disbursement of CDBG funds until funds are needed for eligible costs, and all disbursements requests must be limited to the amount needed at the time of the request. Invoices for work performed are required every month. SUBRECIPIENT may expend funds only for allowable costs resultina, from obligations incurred duringi, the term of this agreement. If no work has been performed during that month., or if the SUBRECIPIENT is not yet prepared to send the required backup. a $0 invoice will be required.
