Agenda 03/27/2018 Item #16A1703/27/2018 EXECUTIVE SUMMARY Recommendation to approve Change Order No. 1 to Contract No. 17-7041 in the amount of $206,443.68 with Thomas Marine Construction, Inc. for the Haldeman Creek Weir (Project No. 60103) ____________________________________________________________________________ OBJECTIVE: To complete the remainder of the construction of the Haldeman Creek Weir replacement project. CONSIDERATIONS: On June 1, 2017, a notice-to-proceed was issued to Thomas Marine Construction, Inc. under contract number 17-7041 to begin construction of a replacement weir for the existing facility on Haldeman Creek in the general area of the intersection of US 41 and Airport-Pulling Road. The summer of 2017 had significantly more rain than the same period of the past 20 years; the month of June alone had rainfall roughly equal to 2 ½ times a typical June in Naples. There was also a direct -hit, major hurricane in September adding to the overall construction suspensions and subsequent equipment remobilizations. The County bid the construction project with the best available information from Geotechnical exploration. The Geotech report showed very little rock in a location abutting the weir site. The contractor encountered extremely hard rock in great quantity directly under the weir site. Given the unexpected site conditions, construction could not proceed as planned. Sheet pile (part of the original weir design) to create a cofferdam for dewatering could not be utilized but rather was eliminated; instead a portable dam system had to be used as a temporary measure to continue construction. As a result, additional heavy equipment and labor costs have escalated beyond original projections. Staff is requesting an additional $206,443.68 for the net construction overruns mainly due to the unexpected geotechnical site conditions. This request represents a 12.77% increase to the overall contract, and has been reviewed and approved by the South Florida Water Management District. In conclusion, due to the excessive rain this past wet season, impacts of Hurricane Irma, and variations in the Geotech in the construction area, staff believes this change order is warranted. This determination is also supported by the Engineer of Record as detailed in the attached letter. FISCAL IMPACT: Total cost is $206,443.68. SFWMD grant funds in the amount of $82,577.47, 40% of eligible expenses, are available within GMD Grant Fund (711), Project 60103. Match funds in the amount of $71,225 are available within GMD Grant Match Fund (712), Proje ct 60103. A budget amendment in the amount of $52,641.21 is required to appropriate additional budget, from the Storm water Capital Improvement Fund (325) to GMD Grant Match Fund (712), Project 60103. This will allow the county to provide the 60% required match for Change Order No. 1. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval. -SRT GROWTH MANAGEMENT IMPACT: The project has no impact on the Growth Management Plan. The services for the project required acquisition of geotechnical data to obtain design parameters for the structural design of the weir, and Tierra, Inc. was subcontracted for the geotechnical services. Borings were conducted on the banks on either side of Haldeman Creek near the proposed structure and along the proposed maintenance road (5 borings in total). Borings were not conducted in the channel at the location of the proposed structure because costs of the geotechnical services would have been roughly threefold, and borings located along the bank are typically adequate for project design, particularly when the channel is man-made, like the Haldeman Creek channel is at this location. However, subsurface conditions are known to vary, even within close proximities. Regarding the proposed Haldeman Creek Weir site, Tierra, Inc. indicated, During the subsurface exploration in 2015 the shallow limestone encountered by the contractor was found to vary across the site. The limestone in this area was encountered from 6 to 15’ below ground surface and is illustrated in the soil profiles (in the report). The borings were performed on dry land, so it is reasonable that the contractor encountered the limestone at shallower depths within the Haldeman Creek. The Tierra, Inc. geotechnical report also indicates that variations in the depth and consistency of this material should be anticipated. Considering these circumstances, and the significant weather factors, we feel a change order is reasonable.
